Yeah same here, I had a hard time finding anything to do with 'Grimoire RPG'. Some guy could just be messing with us for the hell of it.

for GAF we have permision
and the bioshock etc. stuff is all fair use act.

I am not worried, and if not someone messing with us I would love to return the favor to them and put in a counter suit for incomprable damages they did to our game development process. ;)

Yeah I don't see the problem either. Grimoire is a normal word and it's not like that is the only part o the name. :lol

I just took a look into the forums of this company which is of course empty. There are only some rules ignoring all the typos ad stuff I think we are dealing with some real pros here...

Anyone who is suspected to be from RPGCodex or a regular poster on RPGCodex or has a recognized user name from RPGCodex will be banned outright permanently from posting to this forum. No exceptions to this rule.

:lol :lol :lol

Apparently this claim comes from Grimoire Roleplaying Systems, some indie developer (I think? they have no online presence) whose website was supposedly a page on a domain that's now expired. I can't find anything about them anywhere.
The fact it's just an edit to a wiki (something anyone can do), with no contact information whatsoever, doesn't look exactly like anything serious... but honestly you never know.

Of course we're not infringing anything.

1. The names are very different, the only thing in common is a common word that's just a part of both names Should we sue EA because it's using vowels that are in Grimoire Assembly Forge then?
2. The trademark was apparently filed in Australia (but I can't find it anywhere), we're technically US based (hence the press releases from Cleveland) and the official website is hosted in Italy. No relationship with Australia whatsoever.
3. This company has no online presence. No one could possibly have ever heard of them, so the alleged infringement can't be intentional.

facing a bright new dawn
who all is heading up QA again? I've set up a proper 'bugzilla' bug tracker on some remote server space I have. It could be more convenient than using a google doc spreadsheet...it's got a lot of fields and junk we don't need, but the tracking and commenting and logging and attaching and assigning and resolving by user would come in handy

login required is turned off atm so you can check it out without making an account (click 'browse' in the page header). and i can hand over admin account to you guys easily...i've never run one of these before so I don't really know what i'm doin here, just thought I'd give it a shot, lol

http://standard-error.com/bugzilla-3.6.1

This infringement thing reminds me of a few things:
1. What happened to the IP lawyers we had for our team?
2. The wiki needs updating. Maybe I'll do it once this round of QA ends...

Chill the fuck out people holy shit

Look, this guy started e-mailing us at the press account a couple weeks ago. Schuelma and I have been discussing the situation. We've determined he doesn't have a valid claim on us for a variety of reasons.

This is the e-mail I just sent to him:

me said:
Cleve,

Firstly, you cannot copyright a name. A name, such as "Grimoire Systems" or "Grimoire Assembly Forge," is trademarked. Only ideas or specific products are copyrighted.

Secondly, to prove a trademark violation, you must show that damages have been done to you. I did a Google search for the word "grimoire" and did not find your website, grimoiresystems.com, within the first 30 pages of the search results. I did, however, find our own website, grimoireassemblyforge.com, on the fifth page, which shows that we have more mindshare than you and that your site would cause confusion with our own, not the other way around. Furthermore, your website does not identify your company as Grimoire Systems at all — rather, you seem to identify it as "Golden Era Games," so visitors to that site would not associate the name "Grimoire Systems" with your game.

In short, people who see the word "grimoire" in the vein of computer games will not likely associate it with you and what you're doing.

Thirdly, "Grimoire Assembly Forge" is not a real company. It's what we named our development group — it's essentially a club name. We have not incorporated ourselves and none of us are getting paid. You cannot sue a group that is not formally incorporated. Furthermore, Dudebro™ II, the game we are creating, will be released for free on the Internet. It will not be sold in any physical store and we won't charge money for it. The game will not compete with yours any more than any other free, independently developed game would.

Please stop harassing us through this e-mail address and stop vandalizing our wikia page.

Thank you.

So be cool, guys, I have the situation under control. I've known about it, I've looked into it, I researched it and I've responded to it. Dudebro™ development continues!

Actually I "vandalized" the wiki some days ago because most pages had heavily outdated, or even completely wrong, information. Updating it would be kinda pointless, we have the website for that.

That's not the vandalization I meant. I meant Cleve deleting the entire front page of the wikia and posting that copyright violation message in large font.

I restored the version with your "outdated" message, plus my own addition pointing people to the website.

Many people who don't know about Gaf or the game could find it through Wiki. We need people for crossreferencing Dudebro with similar topics, imo.

Also, lol at the Bioshock mention (the page is hosting a photoshop made by someone).
Yeah, there is only a single trademark in the entire Australian Trademark database with the word GRIMOIRE, which is for the subtitle of Final Fantasy Tactics A2.

They are lying, or forgot to actually trademark their name.

But I did find something the company made, they are credited with midi on this site, saying they created it in 1996:

Yeah, you are being langdell'd

Oh, and here are people in 1997 complaining about them:

And while I may of ended up jumping rails to a diffrent company by mistake down the line, if its the same guy, I don't think the people who write for this site care for the man. But since the oldest news, from 2004, has "Cleve left LA for Australia in 1991", I am thinking its this man.

More info on Grimoire

... and this time it's for real!

Grimoire, the most anticipated RPG for the last few decades, will most likely be shipped very soon. Vaporware developer legend Cleveland Mark Blakemore seems to think so, thus he relaunched his Golden Era Games website.
After five years of having little more than a placeholder, the Golden Era Games web site is back! Looks like we may actually be getting some games released soon so we’re going to need it!
We’re grateful to all our frequent visitors over the years who have been wondering what happened to us. We’ re back!
They're back! Will Grimoire put an end to the misery of nextgen RPG offerings and lead the RPG genre to a new golden age?
Look at these screenshots while you're pondering this question.

Edit: Oh wait, its that RPGCodex mentioned above. God damn, we are getting legal threats from a guy who has been trying to make an PC RPG for 19 years. Someone should let him know his trademark expired :lol

He does have a new site though: http://grimoiresystems.com/

I love how I found people on usernet complaning about this guy in 1997 :lol

For some reason, I just picture the guy as an Evil version of Victor Ireland.

But it looks like I am far to late for this, since Dan already got this under control.

I find it hard to think it took this guy more then 15 years to make this. We could do it half the time!:

I was talking about the Dudebro wiki on Wikia: it had a lot of incorrect and outdated information, and updating it would have been pointless because we have the website to host that very information.
The website is also updated twice a week, so updating the wiki entirely and immediately would have made website updates themselves pointless.

Oh I forgot about that. Yea it really is just extra baggage at this point.

I didn't get shit done today due to hype and gushing over all of the new Reach info.

Did this yesterday, quick and sloppy, just like the afternoon I was conceived. It's a totally original idea and has never ever been done before in the entire history of media/sarcasm-

Drkirby: Yeah, I did some research into him, found his website, etc., but I didn't dig back quite as far as you. :lol So thanks for that, it's interesting to read.

Through the press e-mail address, I asked him to prove he is who he says he is and that he has a trademark on Grimoire as it relates to video games. He sent me scans of two documents ... one was an Australian business registration for Grimoire Systems that expired in 1998. He gave no evidence that he renewed the registration, and it was simply a business name registration, not an actual trademark filing. The other scan was a piece of paperwork with his name showing that he is the owner of a corporation called GRIMOIRE SYSTEMS PTY. LTD.

BTW, he was born in Virginia and turned 47 about two weeks ago. Fun facts.

(Also in the e-mail, I asked him to give me the name and contact information for his attorney, which he completely ignored.)

Sill4: Nice design, that's pretty cool! If you give me the image for the back of the shirt (with just the text completing the quote) and make both of them have a transparent background, I can put them on a black T-shirt in the shop.

Fair enough, dude. And maybe increase the beard's length a bit; make it look closer to Dudebro's.
Well, I originally had a long twisting beard that was serpintine and intertwined with the crossed rifles. It was pretty cool, but it was a little too different from the established B.R.O. logo seen On Dawgless's hat. So I opted to keep it simple. But now I'm not so sure...it did look pretty cool...

You know, I would love to see this somehow cause some sort of chain reaction getting Dudebro to be more well known. Have him make a PR announcement saying the game is being delayed because he has to change the name of his game/is suing up, those people on RPGCodex picking it up since they seem to enjoy digging into this guy, and have it progress from there.

Batteries the CRISIS!
oh look what we got in the inbox about 8 hours ago:

new e-mail said:
It always starts like this. I could have just used a form letter for your reply and have you fill in the blanks and mail it back to me.

You are going to change the name of your development team. I began litigation with Crystal Dynamics in 1998 and pursued them to the day of their bankruptcy with court orders and appearance dates right up until their doors closed. We were the ones who required their web host to block their site with a court order.

Your objections that copyright is held by whomever shows up first in web searches is facetious and legally ridiculous. If this constitutes your defense rebuttal I promise you that you are going to lose against me in court.

It's effortless for me because I have close relatives on both continents who are practicing lawyers. They will first find you, gather your details and we will begin our campaign against you without surcease or rest until your web host bans you, just for starters.

You were correct when you said non-profit trademark infractions are far harder to contest. Unfortunately for you, you are profiting from your game development by selling related products in CafePress which makes you a beneficiary of said copyright infringement. This also implicates you in the theft of images from the game BIOSHOCK used to promote your game. I will be sure to notify the appropriate copyright holders shortly.

You and I are going to be good penpals over the coming years and you will find that trespassing on my intellectual property is just like being tracked by Yul Brynner in WESTWORLD. I will never go away. This will never end. It's only getting started.

The solution for you is to change the name of your development team. Otherwise you would not believe what an ordeal I will put you through over the coming months and years. If you think I am bluffing, I will put you in touch with people who are currently on medication because just mentioning my name makes them start screaming uncontrollably. They thought I was bluffing too.

Regards,
Cleveland Mark Blakemore

the cafepress isn't linked to an account, so technically, only cafepress is profiting. but y'know, whatever

also, he apparently doesn't read because i didn't say whomever shows up first in web searches is the "copyright holder." (once again, we are talking about trademarks, not copyrights. what a bright bulb.) rather, i said whomever shows up first in web searches is who has more mindshare, and whomever has lesser mindshare would damage the other. no one knows who he is; lots of people know who we are. his shit would potentially confuse the marketplace that's looking for our game. no one is looking for his game, clearly, so our shit wouldn't confuse the marketplace.

lastly, he keeps talking about his relatives who are lawyers, but hasn't given me a name or contact information, like i requested two weeks ago. but whatevs, i'm sure they'll pop out of the woodwork to sue all 150 of us

P.S. I BETTER START POPPIN PILLS CUZ I'MMA NEED MAH MEDICATION HURR HURR

P.P.S. I totally told this guy to stop harassing us through this e-mail address. Am I going to have to warn him that if he does it one more time I'm going to notify the Australian authorities? Thing is, I'd do it. I don't want to put up with this shit.
