I thought it was weird that EA would do this, but now knowing a user possibly did this makes it really funny.

It's not a rivalry. To be a rivalry, Battlefield would have to be a threat to Modern Warfare and it's not. Activision doesn't care, they're going to sell millions upon millions of Modern Warfare 3.

Two big name FPS releasing around the same time and going after more or less the same audience. I'd say that's the definition of rivalry despite what Activision may or may not think.

ModernWarfare3.com, a joke site that encourages gamers to opt for Battlefield 3 instead of buying the next game in the Call of Duty series, is under siege from Activision.

The American publisher has filed a domain name dispute with the National Arbitration Forum, asserting that the '100% unofficial fan site' has no right or legitimate interest in the domain name.

It appears that the Respondent supports the game Battlefield from the game developer Electronic Arts (“EA”). EA is one of Complainant’s principal competitors in the video game industry, and Battlefield game competes in the marketplace with Complainant’s MODERN WARFARE games and its other military-themed shooter games in the CALL OF DUTY series.

No, they will not. This is not domain squatting, where you sit on domain's name to make money by re-selling it. The domain is actively in use, it's just the fact that it supports BF3 that pisses Activision. Well, they can be pissed as much as they want, won't change a thing. No entity can dictate how you use and administer your website, as long as it's within the boundaries set by law.

well, some could argue that promoting a 'rival' game is use in bad faith, but any legal decision would take years.

Tell that to Nintendo who successfully took back Zelda.com, which was being used as a porn site.

Modern Warfare IP belongs to Activision, so the domain is more valuable to them than the guy who is using it to redirect it to BF3.com or whatever. They will probably get it back easily.
 
The domain battle between Anthony Abraham and Activision over ModernWarfare3.com has come to an end.

A three-member panel of the National Arbitration Forum has ordered the domain name transferred.

Earlier this year Anthony Abraham launched an unofficial fan site for Call of Duty: Modern Warfare 3, attracting thousands of Facebook fans in a matter of days.

In late June, Abraham began lashing out at Activision, the publisher of Call of Duty Modern Warfare 3, in a series of statements and videos that appeared on the ModernWarfare3.com website, and throwing support instead to Electronic Arts’ Battlefield 3.

Activision eventually filed a complaint (read here) which revealed the identity of the Battlefield 3 fanboy.

According to the decision posted online, Abraham argued that the term “modern warfare” is generic and is not monopolized by Activision.

Activision was required to prove that modernwarfare3.com is identical or confusingly similar to its trademark, that Abraham has no rights or legitimate interests in respect of the domain; and the domain name has been registered and is being used in bad faith.

The three-member panel ruled in Activision’s favor today, having established all three elements required under the ICANN Policy.
