Thanks for letting us know you wish ill will on someone who's received a pretty damaging setback in their career.

yeah, i dont really watch his shit either, but this has gotta be tremendously upsetting for him. cant wait to see which company sent in the request...meantime, could his site just link to something more forgiving like dailymotion?

This copyright infringement shit is getting out of hand, next thing you know they'll take down channels for posting video game trailers and interviews.

They probably already do. Trailers get taken down all the time, and probably interviews too if they originate from another source and get rehosted. I won't be surprised if some channels have been suspended for repeated violations.

Well I know they won't let me monetize any interviews I conduct. Not sure what the law regarding the usage of interviews is for profit and such though.

This doesn't surprise me, my youtube got banned because I had videos of story mode of BlazBlue:CS. I appealed, got my account back and then my videos all got taken down again within a day and no other appeals have worked (I end up getting an e-mail saying "We think you're abusing the appeal system, blah blah")

I do find it odd that we can't have video games videos, even non-trailers (ie actual games, being played) on youtube (depending on the game, who owns them, etc). If it has certain audio, certain visuals, whatever or just a game that the company doesn't want on there, you can have them removed and after 3 removals for copyright issues, you can be banned.

But on TwitchTV? It's fine, as long as you're not playing something illegal or playing something early before release date, then you're fine.

But eh, you can't do much. Google only listens to those with the money to spend on lawyers. Like most companies that wanted youtube to have a copyright infringement system like this.

Sony gave me a copyright strike because I uploaded a Vita game trailer they didn't : / Square Enix, and Namco Bandai also can suck an egg for doing that too.

That's Google these days. They give zero fucks about anything other than making scads of money. The search engine has gone to shit as well.

They take a "take down content first, ask questions later" approach to sidestep companies who would try to paint YouTube as a piracy haven.

For them it's better to be safe than sorry. TwitchTV is for games...it's a little different to stream games than it is to potentially host TV shows + game replays + movies + cartoons / anime, etc.

Maybe James will post something about it on the Cinemassacre website tomorrow. Guess we'll have to wait and see.

EDIT: What's with all the Sega assumptions?

Sega has being shutting down peoples youtube channels for any mention of old games, more specifically any mention or footage of Shining Force 3. A game that you can't buy through any legal channels.

TotalBiscuits channel almost got shut down due to Sega and he received 2 strikes.

Holy shit, if this is true, then fuck this guy and his "help".

EDIT: What's with all the Sega assumptions?

SEGA has been taking down Youtube videos and accounts relating to the Shining series in an attempt to prompt up the search rankings for the videos of their new moe blob porn art Shining Ark game on PSP. First they took down videos with music, and footage from the older games then they started taking down videos that just had a dude talking into the camera about the series. : / To be that bad takes AGES.

In the appeal e-mail after I first appealed on my old channel, it said they would more or less let the person who took down the videos in the first place decide if it was correct or not.

What's worse is, it's been proven that people who don't own content (or own a real company) can set it up so they can either monetize stuff that isn't theirs using the copyright system (the "You have stuff owned by x, ads may appear on channel" etc) or even take down videos/get channels banned so the appeal system can make it harder to get your channel back.

Of course, if they don't respond to the counter-notification, videos can be restored but even if it is like mines was after that amount of time, they got taken down again within a day. And afterwards, they said I was abusing the appeal function. (I even intended to take all related videos down once I got my account back but :/ )

edit: I do think though that while there is lots of stuff, TV shows, whatever posted on youtube, most companies would be better off monetizing those videos rather than removing them. Would make them money and would anger less people. but Eh.

Youtube gets worse by the day. I'm actually a little surprised that more people don't use their laughably abusable DMCA tools to troll. These guys are downright desperate to maintain their safe harbor and keep the ad revenue flowing.

Sega was supposedly responsible for taking down Youtube videos showing the older Shining Force games so that more people would look at videos of the newest Shining Force game.

Wow, this is pretty stupid. Thanks for the info.

Youtube's certainly making a compelling case for why copyright law can't stay the way it has for the last century or so, especially with the DMCA. We really need something that pushes WAY towards being fair use friendly at least, though with how quickly the media will cycle through properties now maybe even the ancient limits on copyright actually are applicable again.

Wait, so you guys are telling me that they take down channels for trailers too?! Why!? Isn't that free publicity?! Will your game sell worse if they distributed a trailer? I don't get it, what's the reasoning behind this this!?

Control, that's all the reasoning they need.

Sometimes a gaming site will publish a trailer and then the automated system will automatically assume the gaming site owns the content and then removes the video from other people who upload the same trailer.

Hmm, I'm subscribed to about 55 youtubers and over the last year or so about 10-15 have run into account deletion problems. I respect Youtube and Google are respected companies (who can be held responsible) and they have to show that they are tackling copyright issues but their increasingly draconian auto account deletions (especially without warnings) just feel like they are going to drive the LP and other game streaming communities to other video uploader sites.

Its usually down to companies having their own channels these days so they want people to view trailers directly through them rather than a 3rd party channel and to do this they set in place content ID restrictions. Youtube is getting shittier every year.

Yes, copyright in the commercial entertainment space these days is really all about control. They want to control how people see something, and how they are introduced to something, and so on. The more closely they can "manage" the marketing of something directly, the better it is for them.

It's the fact that they're using copyrighted content in their work... that's always the issue here.

It's fundamentally ludicrous and stupid, but that's why YouTube has so many problems with these guys. It is a massively popular website with millions of people watching its every move. It has to be draconian or it'll get shut down.

We're not talking about a rogue piracy site here. We are talking about the 3rd most visited website IN THE WORLD.

I believe you mean "sucks monkey fuck", good sir.

Or perhaps "this pukes snot up my ass"?
What? All this time I've been hearing it wrong? Damn!

I'm not worthy of watching his videos anymore. I deserve public shame and a physical punishment. I'm sorry James, I'm worse than an LJN game on the 3DO.
