Nothing wrong with it. A moderator has to actually enable you to use avatars of your choosing before your avatar will change to it, assuming you have it in your profile.

I thought we couldn't do animated gifs anymore? I'm no expert, as I have avatars turned off, but I thought that was the deal.

Well, it is, but you clearly didn't check the FAQ :/

Avatars can no longer ban animated, it may of been a rule that only passed about a month or so ago but it wasn't something easy to miss. I would read though the FAQs if you haven't, or else you will likely break some rule fast that gets you banned.

I think 40 by 40 should work, but it doesn't hurt to ask.

EDIT: It resizes to 60 by 60, which is within the limits.
