Fun fact: He was supposed to just toss the pizza, the pizza landing on the roof was accidental and they loved it enough to have that be the take. It's even more awesome because they later shot the pizza rotting on the roof later, and Walt has to eventually take the pizza down.

This has happened to games before that eventually released, and it's much more likely that Sony will reestablish the trademark soon, is planning a renaming, or considering a movement to another console (PS4, or even Vita). Until Sony comes out and says it is cancelled, it is premature to assume cancellation.

Sony filed an "Intent to Use" application as a placeholder years ago. Basically, you can file this on the principal register so that no one else can use the mark, but it is conditioned on the actual intent to use the mark. You can just squat on it. They got many extensions, and it seems that they just didn't file this latest one in a timely manner.

If you look at the extension approval from January 13th, you'll see that they got a 6 month extension, but would have to refile then. It doesn't look like they did. SO, either they just screwed up and forgot, or they are actually abandoning the mark. I would think that it's the first. Having to remember to file these things could slip by someone in their legal department. Keep an eye out; I'm sure they will make a filing soon to remedy this. If not, THEN this thing has been truly abandoned.

Edit: Also, terrible reporting from IGN. It took me 2 minutes to find the history of filings. Granted, I've taken a trademark class, but still, they should have reached out to someone at the very least. Pitiful.

It doesn't have anything to do with the system. They're games from very well loved studios that defined the previous generation for a lot of people. If The Last Guardian was coming out for the 360, you'd see the same kind of buzz and speculation.

I know, I just categorized them as PS3 games since they're on that system, shorter than typing them individually.

I think flipping out over this is premature. A trademark being "abandoned" just means it was registered and left unused for a certain amount of time, so it reverted back to the public domain. Sony does not seem to have actively "abandoned" it and it's pretty to re-register, from what I understand.

But its fun to flip out.

Don't think this means much but can't wait for this to miss TGS again and enter its EIGHTH YEAR OF DEVELOPMENT.

Going into this gen (2006) I had three main things I was really looking forward to:

-Next gen Silent Hill from Team Silent.
-Next gen Final Fantasy 'trilogy' (i.e. FFI-III on NES, IV-VI on SNES, VII-IX on PS1, etc.)
-Ueda's next game.

Here's what I've gotten:

-2 outsourced 'fanfic' games by mediocre devs, a bizarre waggle adventure, also outsourced, on inferior hardware (even though I actually loved Shattered Memories :D), and an embarassing HD 'Collection' that insults two masterful games instead of celebrating them.

-1 under-developed (this game needed another 6 months) mainline/offline FF, an apology 'sequel, 1 horribly rushed online entry that had to basically be pulled from the shelves and is now 'relaunching' two years later, and....well.... Versus. :/

Fortunately I've gotten a lot of great new things out of this gen, but damn... it's depressing looking back. Out of all 3, Fnal Fantasy is the only one that might still be able to recover (FFXIV v2.0 ending up being awesome, Versus delivering, and maybe a surprise XV reveal?)...

The NoA for the Last Guardian mark was actually issued in Jan. 2010, which would give a limit to Jan. 2013 to prove use in commerce.

Use in commerce meaning Sony has to prove they released the game, which I guess they realized wasn't going to happen by January.

They might think that having "The Last of Us" and "The Last Guardian" coming out in the same year could confuse some casuals.

It is not proper to file an intent to use application if you are simply trying to "tie up" the name and you have no real intention to use the mark. You may, under some circumstances be asked to prove that your intent was bona fide: for example, through Board of Director's minutes showing actions moving toward its use, or through proof of expenses being incurred in preparation of product or packaging bearing the name, or some other reasonable proof.
