However, the trial judge did not hear it that way, because they have rejected the complainant on 31 May 2011. The detainee has nevertheless continued until appeal, where he has just suffered another setback. The Fifth Chamber of the Administrative Court of Appeal of Marseille, in a decision dated February 28, 2013, has indeed held that "the director of the Central House of Arles could quite take the contested decision on the basis of the circular of 13 October 2009 , which allows him to deny an inmate who is transferred within the facility to keep in his cell a games console when it believes that this console is a connecting console may cause security problems. "

A question of order and security

It appears that Article D449-1 of the Code of Criminal Procedure provides that "prisoners can acquire (...) computer equipment," such as video game consoles, but that "the equipment and data they contain are under the control of the administration. " The same article states that "any computer equipment belonging to a prisoner may (...) be retained, to be returned to him at the time of his release," especially "for reasons of order and security."

In short: the director is free to prohibit an inmate to use a video game console, since it believes that it may present a problem or security (communication with the outside or between prisoners .. .). Or in this case, the PlayStation 3 Mr. B. has been audited by the prison administration, which "failed to ensure the inhibition of prohibited technologies", are the judges. For instance, the SONY console has native Wi-fi connectivity.

In addition, it appears that a note prepared in July 2010 by the Direction of Prisons evaluated game consoles last generation, which includes the PlayStation 3. The note "showed that even if a console is not vulnerable at a given time, it may become later, after undergoing software modifications not intended by the manufacturer," wrote the Court of Appeal. i find it amazing that he would go to court many times because he wants a ps3 and no other console.
I only own a ps3 and am really not interested in an Xbox but i would get one rather than spending time in court and risk getting nothing at all

Great catch by them; I could definitely use any PS3 and have some true fun if I was already in prison; but it would be a bit harder with a Wifi-less 360.

Is it sad that I find prison to be preferable if I can just game like that guy? I hate responsibility and all that shit, so I wouldn't mind murdering someone and just game for the rest of my life.

Yeah, Prison is designed to be a form of Torture. Not to protect civilians. You hurt me I hurt you? Prisons can't be too nice because of the cost that would involve. But intentionally trying to damage prisoners and make them want to hate society more by the time of release? That's unreasonable.

The point of prison is part punishment, but part rehabilitation as well. I'd rather have inmates play games, then do crazy shit to each other out of boredom.

You need a good lawyer for that. Negotiating benefits for your mental/physical health. And actually theres lots of prisoners who commit crimes shortly after release, because they find community, food, and acceptance in jail. So once they're finally released they don't know anything else.

So basically every Wi-fi device is banned? That sucks, although I guess you can still pick up a PS2 and play JRPS like Persona 3/4 or FFX/XII.

The European court of Human Rights even rebuked us in January, for "inhuman and degrading" treatment of inmates.

Makes sense, modern consoles could introduce a big security problem... anybody could set up a wifi network close enough to the prison for the inmates to connect to it (they could even mcgyver a directional antenna to emit from further away and/or target a specific area of the prison), and freely exchange messages with people outside.
Many modern escape plans start with getting a cell phone inside the jail, with a connected console you wouldn't even need that.

As if it was "comfortable" to play videogames all day in a 2m cell.

Anyway he said the prisoners should go insane. And that wouldn't help at all, because later those insane people would get put back into society and I think noone would want that. And if you don't want to put them back, then well you could also just kill them. Which is pretty stupid in its own right.
