Well you aren't allowed to keep playing it. :P Microsoft has no way to remove a game from your account, and their only way to fight abuse is to ban those who take advantage of them and play after a refund. Ms is not giving him the game probably. He still has it on his console because they cant remotely delete content from his console. I doubt its in his download list

Come on, don't take it THAT serious... and, morally, I agree that if you get a refund, you should stop playing. But what is morally right and legally right not always is the same.
I have the same here, SimCity. Broken, absolute rubbish. Pre-ordered the game, got the free game but still asked for a refund. The free game still there, but never touched it.

Microsoft didn't have to give me the refund. In the TOS it says no refunds. They only did because they know the game is so broken. It's not his fault that he can play the game, and that such a system is not in place. But frankly, there SHOULD be such a refund system, because the way it is, if he can play the game forever after the refund, is an insult to paying customers, not an insult from him, but from whoever that doesn't put that system in place.
