Ok, here is the full story since people were asking. This is Xbox One version purchased via Xbox Live

Monday night I spent two hours trying to get into a game and was only able to actually connect for around 15 minutes of that two hours. I logged onto the Xbox Support chat and asked for a refund and linked them to all the stories of the game not working. They said they could not do a refund but someone from Tier 3 support would contact me within 48 hours. 48 hours later no one had called, so I called them. I gave her my reference number, she put me on hold and 5 minutes later I had the refund. A while later I logged into my account and noticed the game was still there and I can still play. To those saying this is unethical, I did not ask to be able to keep playing the game I just asked for a refund on a broken game.

Well you aren't allowed to keep playing it. :P Microsoft has no way to remove a game from your account, and their only way to fight abuse is to ban those who take advantage of them and play after a refund. I really don't advise you keep playing, least you want to lose your entire account forever.

Exactly what nice thing are you referring to? Battlefield 4 being broken is not a nice thing.

I strongly doubt they are going to ban me. I did not ask to keep the game, and I can't really play it much since it doesn't work for more than 10 minutes at a time. I was mainly letting people know I was able to get a refund in case others were wanting one.

I've had something similar happen to me with an App Store refund from Apple, and their Keynote app.

they patch it* and you havent paid, and the only reason you can access it is because they have no physical way to delete it from your console, its piracy...

This happened with Origin when I got a refund for Sim City but when I restarted a few weeks later it was gone.

Don't see anything wrong with the OP keeping the game if it ever gets fixed, though I think it's a little questionable to start a thread encouraging everyone to do it

Come on, don't take it THAT serious... and, morally, I agree that if you get a refund, you should stop playing. But what is morally right and legally right not always is the same.

I have the same here, SimCity. Broken, absolute rubbish. Pre-ordered the game, got the free game but still asked for a refund. The free game still there, but never touched it.

I cannot delete it from my console because there is no storage management on the Xbox One.

You can uninstall it, just goto my games and apps, highlight BF4 press start (whatever it's called now) should be an uninstall option.

Ah yes, forgot that fact. But still, you dont legally own a license to the game anymore so its not exactly a legal copy.

The OP was entitled to a refund. I don't think a buggy launch entitles him to a free copy of the game. I feel like the refunds won't be an option anymore once people start exploiting the system, which would be a shame.

I ended up getting 2 copies of battlefield 3 for free, one physical and one digital due to all the trouble I had with the game at launch.
Didn't work for at all for at least a week, maybe 2.

I believe for these people it's less of a defense of EA's shitty moves and more of a defense of the industry overall. Like, what if this happened to a genuinely hardworking earnest indie developer? Or even just the hardworking developers at Dice who ran out of time or something. They don't want to set some sort of precedent.

The weird thing is that dude still has the game and is still playing it.

Microsoft didn't have to give me the refund. In the TOS it says no refunds. They only did because they know the game is so broken. I sent them links to articles about the problems with the game when I was chatting with them.

Another thing I was just thinking about - MS really should have had a way to remove games from people's accounts considering a few months ago this was going to be an all digital console. If you were banking on so many people purchasing game digitally, wouldn't you put a refund and revoke mechanism in place? I assumed they had this in place when I asked for a refund (maybe they do and it will just take a few days for the game to disappear)

It wouldn't even really be SO bad if they actually counted XP without forcing you to finish the match.

There are few things worse than having a decent game go on for like 30 minutes, only to crash and have completely wasted your time.

This same exact thing happened to me on PS4. I asked for a refund immediately (before conquest worked) and it took about 5 days but they gave me my money back and I can still play the game.

Essentially the OP and I got the game for what its worth: nothing.

If it's not exploiting the system then you're arguing that MS intended to give people refunds and allow them to keep playing the game. Doesn't sound like a great way to turn a profit.

You're implying that the customer is pulling some kind of trick. This issue is simply ms/sony giving refunds and not asking for the game back.

Well, they could put a system in place, that remotely disables the refunded content first time user logs in to Xbox Live, and THEN does a refund after successful disable.

It's not his fault that he can play the game, and that such a system is not in place. But frankly, there SHOULD be such a refund system, because the way it is, if he can play the game forever after the refund, is an insult to paying customers, not an insult from him, but from whoever that doesn't put that system in place.
