Yes, this is interesting. There has to be some sort of ramification for late payments. Can any of the indie devs on here provide some insight on if there were any such items in the contract?

XBLIG sale stats are regularly frozen or sometimes disappear in a black hole for weeks, I stopped paying attention to it a long time ago.
 
I've worked contact work almost all my professional life, and sadly stuff like this isn't rare even with big corporations.
I personally haven't had a big company screw me...but I've had friends chase money from big companies for weeks before getting paid. It's sad how big corporations think they can walk allover the little guy.

That doesn't sound good at all, especially so when you're selling digital products that should be easily traceable and difficult to account forbon your end since there's nothing physical to account for. How are you even sure that the amount you sold is actually accurate if you can't trust the system to give the stats? Do you have such problems with Sony, Nintendo and Steam, if you have games on their services and if you can comment?

I have to imagine that someone at MS is fucking up royally. How does a multi-billion dollar corporation not pay what they're contractually obliged to pay?

I've worked at one of the larger credit management/information companies for quite some years. This is par for the course. They're banking on these small devs swallowing everything because they don't have money to lawyer up. Basically if a company like MS is one day late, you should immediately send reminder invoices and threaten legal action / enlisting a collection agency. And even then they're calculating only a few go to court and they make enough interest off the rest. But the moment lawsuits are being fought for a few dollars, credit information agencies know what's up.

Each quarter Microsoft then pays said developers their portion of the games sales. The system itself also includes a clause that payment is not considered “late” until it’s beyond 45 days after the stated payment date.

the new parity policy meaning an indie game can’t be released on the Xbox one unless it either releases first on Xbox One or on all platforms at the same time.

What a shit company. Pretty toxic for the industry.

I'm really not surprised by this at all. I stopped developing xblig games over a year ago now, due to the way myself and many others were treated by Microsoft. It took them over 18 months to pay me. I ended up having to threaten them with legal action before they took notice. And believe it or not, that was only the tip of the iceburg in regards to my issues with them.

So is there even a reason Microsoft has to give them all their share of the sales at once on a quarterly basis? As opposed to programming the digital shop so that any purchase made automatically gets divided and sent to the proper people? I can understand with physical shops and media where you'd need time to compile the information and it's not all just code, but I can't imagine that it would be that difficult to set up a digital shop so that the money is automatically distributed as per contract, especially if it's part of a standardized program where all devs have the same contract

Sorry we didn't provide an adequate environment for your corporate defense. These billion dollar conglomerates just don't have enough representation nowadays! I would suggest a career in business law. I'm sure one of them could use your help defending tax evasion, waste dumping or some other such misunderstood practice.

It's even worse when big companies have, say, a 45 day pay period cycle, where they pay out all their contact work every 45 days. And they miss a payment and tell you they can't cut a check for another 45 days due to their cycle.

Suddenly one missed pay period and I found myself without pay for 135 days. That was absolute madness and it came from one of the biggest business solution companies on the planet.

He has a point. There's no need to accept shitty business practices for the sake of the almighty competition. The problem with so many people is that they allow their obsessions to get control of their ability to not take shit. Things tend to work themselves out. Nature does it and so can we.

60 days is not much to get concerned about IMO. Most companies have a 90 days policy for these kind of transactions. I sure know my company uses a 90 days policy.

It varies from work place to work place. I did work for hisd in Houston once and they operated on 90 days.

Thing is, you're supposed to know that policy up front to let your contact work budget around said periods. If I'm expecting pay in 30 days and its not coming for 90, I'm probably going to be living poor for a bit.

Yeah. That's NET 60, NET 90. Common business things, but this is like tacking on an extra 3 weeks to NET 90.

Agreed. If the payment terms were agreed upon before hand then you have to respect them.
