DSFix 2.3 taken down after DMCA complaint [Up: Was mistake; being resolved]

Some random legal guy in Germany probably saw Dark Souls Fix, assumed it illegally included or modified their program or code (or was a "fixed" crack of the game) and sent a request to have it taken down.

It probably wasn't even a person that found it, but a web crawler that was looking for Dark Souls debug stuff on file sharing sites. The human who sent the actual DMCA takedown request simply didn't know what DSFix was and didn't notice the false positive.
 
Obviously the more people who create a stink about this the quicker it gets sorted out, but I don't think there's some grand scheme to screw with Durante after all this time.

Either some legal bod at Namco EU overstepped the mark not understanding what he's looking at or DSfix is collateral damage from the debug build that's out in the wild.
 
Shocked at first. But the story about FDS (represented (in poor English) by Volker, who I'm going to give the benefit of the doubt regarding intentions and mistakes) being tasked with removing the debug fix wherever it's found, accidentally sweeping Durante's file in a DMCA claim (doesn't help that it's popular and perhaps been used alongside the debug by users), is believable. I hope this doesn't hint at one or more branches @ Namco Bandai wanting to nickel-and-dime for custom options/DirectX in an upcoming Dark Souls re-release...most likely this was a mishap of communications, or lack in prior knowledge by a contractor.

We need to add these details to the OP so members can get a better first impression of the situation. I mean, yeah, it's fun to beat on Bamco's doorstep for other reasons, but nothing's confirmed as of yet. Best case scenario, claim gets removed (either through a counter-claim or by FDS + Namco Bandai), one of the community managers reports and confirms this was a misunderstanding, and Durante gets to buy his next boat.

What probably happened: German legal branch just googled dark souls and sent c&d to anything he could find, so that he met his minimum monthly quota of work so that he didn't get fired. had no idea what he was clicking on.

Japanese Branch: Has no idea what DSFix is, probably doesn't know that there's a German Legal Branch either.

Western Branch: Probably doesn't actually exist. likely just some spinning records in a closet somewhere.


Big thing: Communication between worldwide branches of a large company between language barriers is basically impossible and no one knows or cares what anyone else is doing as long as there isn't a panic alarm going off.

If this is true then it's just another example of how easily abused the DMCA is.
 
Takedown notice is the biggest, ungrateful Fuck You they could every give to their customers. If anything, they should cut Durante a big fat check for all the additional sales gained by DSFix.

His point is not that its not a bad port, but that its hyperbole to call it one of the worst ports of all time.

You should be ashamed of yourselves for doing this to a guy that improved your game and brought you thousands upon thousands of sales and all of it for free.

What the fuck?! Why would they do that? This is simply unbelievable. Vanilla DS wouldn't have sold even half the copies if it wasn't for the DSFix. It makes no sense.

I thought I hated Dark Souls until I patched it to 60fps. Turns out I just didn't like the framerate. The game itself is awesomesauce.
 
Durante, you should make a ruckus. Get the gaming press involved if they aren't already.

Either this was a mistake and they'll redact it or they'll look like a fucking joke to the industry.

I would be very surprised if this was anything but a mistake (someone thinking it was a crack, I guess). Both the random timing and the fact that it came from the German office suggest so.

Only problem might be to get it sorted soon, but companies being in Christmas break now...

Anyway, let's play DS with 720p on PC while my PC can output x3 as much.
Hell, I will accept 1080/60 but of course, it is a bad port so they couldn't do it.
It is a bad port by not allowing gamers the ability to maximize their PC.

It isn't the worst, but it is one of the worse ports.
Any ports that don't include resolution options that exceed 720 is a bad port.
PC porting should always include resolution setting, and better graphic configurations as default.

I've been playing PC games since the late 90s and nothing really bothered me as much as the Dark Souls launch. I don't think it's hyperbole to call it one of the worst. Some games launch flat out broken and later get fixed. DaS never even got fixed officially. It's a terrible port by modern standards.

I, for one, am glad Bamco is protecting me from shady, unapproved patches. Those might degrade my game experience and it's very important for me to have the best game experience possible.

They should integrate the fix in the game's code and thank Durante instead of looking like dicks across the world.

When you say it does not contain any material of theirs, you mean it does not even do any binary patching?

IIRC the framerate unlock alters some things in memory, but that's it. Everything else works by intercepting DirectX9 function calls, e.g. the game asks for a 1024x768 render surface but DSFix replaces that with a bigger one.

Nice that they waited 2 years so that everyone could buy their broken game first. The game doesnt sell a 10th of what it did on pc without the fix.

I wonder if Scamco did this for the upcoming Dark Souls 2: Scholar of the First Sin edition. But still, this is really fucked up. BASED DURANTE is the reason why I double dipped on Dark Souls 1 & 2 for PC in the first place. Truly fucked up from Scamco; Durante was helping you get your game right in the first place.
 
Jesus Christ, Scamco should be sending Durante royalty checks for the PC version. DSFix is the only reason I bought the game in the first place. The vanilla PC port is a hot mess.
