I found a vagina in Watch Dogs 2 and Sony suspended me (Update: Ban lifted)

I received my copy of Watch Dogs 2 on Saturday evening due to a mistake on Amazon Prime Now and I've been having a great time with the game so far. On Sunday evening I accidentally blew up a few women in a back alley with a gas pipe and then I saw *it*; someone at Ubisoft had rendered a full vagina on one (or maybe more) of the females in the game.

I took a picture of this funny oversight with the ingame camera and shared it on twitter for my friends to see and I posted it in one of the Watch Dogs early release threads on here. Cut to tonight where I can't access any services while playing the game and then when I tried to sign in there was a very brief message about my account being suspended.

I checked my emails and this is what I have received from Sony:

We’re writing to inform you that your Sony Entertainment Network account has been temporarily suspended.

We’ve made this decision based on your online activity in Live from PlayStation on 14-11-2016.

Content of an adult or sexual nature is against our Code of Conduct.

The suspension will last 1 week and will be lifted on 21-11-2016. You won’t be able to access online multiplayer, PlayStation Store and other network features until the suspension is over.

We take the decision to suspend an account very seriously, and we only do so after one of our moderators has carefully analysed the situation. PlayStation Support therefore cannot overturn this moderation decision.

We ask all our players to act decently, respectfully and with consideration for us and other players while using PlayStation Network. To make sure you understand the behaviour we expect from our community, please review the Code of Conduct here before returning to PlayStation Network. Please be aware that any further breaches of the Code of Conduct may result in a longer suspension or even a permanent ban.

So I now have a new game that relies heavily on online features that I won't be able to enjoy this week and a mark on my record for an easy ban whenever they next decide I've exposed them for being crap at cert.

Do you guys think they were right to suspend me for sharing content they've allowed on their platform?

Weird i also made 2 clips of a naked woman and naked guy but i only got a warning not a suspension.

That's the question. Will under aged users see what you shared? If yes, then your suspension is valid. I do agree that allowing all the violent shares to be fine and nudity being not fine is asinine.

I'm really disappointed right now.

Wow, that's dumb and I also assume that you pay for PSN+ so that means you pretty much paying nothing for a whole month but yet Sony is still happy to take that money.

As far I am concernyou did nothing wrong as that content was in the game and all you did was share it on Twitter.

Post an image of genetals in a game, get banned.

But why is it valid? Shouldn't Sony make it impossible for underage users to see such content? I mean this can't be hard to implement.

Jesus, they are really out to get you huh. This is some anti-consumer bullshit right here. I shared a crapton of videos of BJ Blaz mutilating people in Wolfenstein, which is apparently fine I guess huh. Yeah, yeah I know their policy is "no nudity". But what the hell is the point of the share button, eh? Sounds like they are punishing you for their pretty stupidly thought out sharing system. As you can share whatever M-rated scenes you want, unless they are ones they don't particularly like.

Whoa. That's not ok at all and I can't believe Sony isn't getting flamed hard for this. They're pretty much trying to strongarm you into shutting up about it. I don't understand how your ban could be extended if you can't even access online services. That's bullshit. I'll make sure to buy all my multiplat games from a different service because of their behavior. The first ban is understandable because of the TOS. The second ban has no justification.
 
I don't agree with the original ban, but it's not that shocking.

What is shocking is that these things also exist in the real world and every woman has one... scary, right?!

imo, Sony did the right thing, stuff like that must be banned. Just because you can doesn't mean you should – any adult person should realize this.

BTW, Sony Interactive Entertainment and SEN's PlayStation Network Terms of Service are chasmically broad, but Goron2000 might have difficulty finding a leg to stand on. Here's a relevant line for this situation:

You may not take any action, or upload, post, stream, or otherwise transmit any content, language, images or sounds in any forum, communication, public profile, or other publicly viewable areas or in the creation of any Online ID that SIENA or its affiliates, in their sole discretion, find offensive, hateful, or vulgar. This includes any content or communication that SIENA or its affiliates deem racially, ethnically, religiously or sexually offensive, libelous, defaming, threatening, bullying or stalking.
But also, Sony attempts to absolve itself of any responsibility legally for allowing anything violating TOS to happen on its network, so they're having it both ways...

Unless otherwise required by law, SIENA is not responsible for monitoring or recording any activity on PSN, including communications, although SIENA reserves the right to do so and you hereby give SIENA your express consent to monitor and record your and your Sub Account's activities and communications.

I don't understand why people are defending Sony. Why does Sony have any interest in what appears on OP's twitter? If he used his phone camera to take the picture off the screen and posted that to twitter would Sony still be justified in banning him?

I'm expecting Sony blocking all sharing from mature games for everyone now.

It would be nice if they did something to work out how content from a game approved for release on their own platform (it's a little different if somebody streams on the PS Twitch tool or somebody could screengrab something from a DVD movie) violates the TOS. Think of the kids so that I don't have to care about the stupid parents, please. But we're several years in now to Live From PlayStation and they've not taken any action about filtering M-rated content from family-approved content, so I don't know why they'd take drastic action now instead of just banning everybody who screengrabs a WD2 naughty bit until word fully gets out. It's mostly an isolated issue, there aren't constantly games with vaginas in them (but oddly, there have been a good number of penises in games, who'd have figured?) to put them in perpetual crisis.)

If their goal with bans like this is to protect minds of innocent then yeah, maybe they should. If your sharing feature is basically rated E meaning everyone from toddler to gramma gets to see shared pics and clips maybe there shouldn't be violence either.

Did they not for one second stop to think that someone, if not many people are OBVIOUSLY going to share such an image? It would require ignorance of the highest order to lack this sort of foresight. Did they not think hey, if we put this in the game and people share it, might their accounts be banned?

I'm not putting the blame on any one thing specifically, but this entire situation is fucking embarrassing and demonstrates a lack of professionalism.

Agreed. The best way to enforce this is if they filter out any shared media of M-rated games out of any systems with parental controls. This banning business is not right.

Sometimes I just want to share things directly to my Twitter followers, but don't Twitter posts automatically show on feeds? I understand Sony has their own terms and condition to enforce, but the workflow of this gives the user the impression that they're only restricted my Twitter's terms.

Eurogamer and Polygon both have article up on this, but both are yet to react to ban extension. If they pick up on that could put totally new spin on this story.

That's not even a thing. Sony has plenty of games with nudity in them. Heavy Rain, basically every God of War, to name a few.

Can't blame the devs for this.

We have age rating systems so the developers/publishers can make whatever game they please and people will be informed of its content beforehand.

No, couldn't be... sorry, I don't know enough about it, somebody here please enlighten us both.

I am going to assume that something about using the tweetdeck of the PlayStation 4 console itself to post that image to Twitter tags it internally or catches it in the post-upload process through the console to put it into the Live From PlayStation feed?

Unfortunately, the more we push it, the more problems it could cause him and his account. The rules are pretty broad for a reason and like a referee in sports, calls are often open for interpretation.


In this case, he broker the rule once by posting the image, then again by posting the image to Twitter/Here and linking it to his PS account.

While I believe they shouldn't charge him twice for the same image (double jeopardy) but he has no doubt broken the ToS.

now realistically, is there a way for them to trigger a capture block when a vagina flashes on screen? How would they manage it in an open world game. For cut scenes it's pretty easy to manage, but not open world games like WD or GTA.

This isn't quite right. There's a What's New section on the main menu, which is a Twitter-like feed of the activity of your friends and people you follow:

was the same thing when I got suspended from Youtube live streaming for 3 months for a Witcher 3 sex video. despite there being plenty of others of the exact same scenes (and no other distinguishing characteristics), I had no defense because it's clearly in violation of their TOS -- regardless of how they enforce it case by case

whether's it's youtube gaming, live from playstation, i presume twitch... probably any other similar 'live' game service... just because it's allowed in a game does not mean it's allowed in their streaming tos -- and even if they don't always enforce, they can and sometimes do suspend ppl without warning. and i think in all 3 tos, it can include sexually explicit or excessively violent content.

but what i don't get is that showing in game nudity via the share options is banable, but sharing extreme violence isn't?

Surely if it is in this wierd world, then share should be disabled for the game if they are so worried?

besides which now this is blowing up everyone will be sharing it, are they gonna ban everyone?
 
Could it be just a clipping problem because the base model is in the nude (because of the nudists)?
Maybe there are supposed to be panties there and it's a case of rigging going haywire.
