On December 20, 2016, Nintendo of America Inc. filed in the US via the United States Patent and Trademark Office (USPTO) a trademark application for "Eternal Darkness". The filing basis is 1B (Application based on intent to use), goods and services are related to game programs/software. The application entered the Trademark Reporting and Monitoring System (TRAM) yesterday on December 23, 2016.

I have written several times about another trademark application (filed on July 23, 2013) regarding Eternal Darkness. US Serial Number 86017853, Eternal Darkness, is still in force but Nintendo has only until the end of the year (with a short grace period) to provide a Statement of Use, or else the application will be abandoned. Likely they will let such happen. However, there are some small differences between the old and the new application, mainly the goods and services. This could just be slightly updated terminology on USPTO's side, but still worth pointing out.

As usual, a trademark application is not confirmation or denial of a product or service being developed. Nintendo's intentions in this case could be simply to retain the trademark for future use, or they could be actually working on a title set in the Eternal Darkness universe; it could be an HD remaster, a Virtual Console release or an entirely new game. What can be said is that Nintendo seems very keen on not losing the trademark allowing for anyone to try and register some game under that name.

Nintendo has approximately 36+ months (the older application has been in the system for around 42 months) to file a Statement of Use for this new application. Once the USPTO issues a Notice of Allowance they can start filing every six months calculated from the NoA Extensions of Time to File SOU.

I'm pretty sure they filed to not lose the trademark, though of course hope they do something with Eternal Darkness. I'd even take an HD Remaster.

I'd like to believe they renew the trademark every year as they plan to do sonething with it, but this has been going on for many years now.

GC VC release is very likely at this point. Which is exciting for me, as I never played the game first time round.

hopefully the Baten Kaitos games will be re-released too

that would be something worth checking out.

I don't think anyone should be allowed to run a company if they think a sequel to Eternal Darkness would be a system seller. The original was not a big seller in the slightest.

Pftt it will after Nintendo releases Eternal Darkness GO on the App store. It gaslights you for real.

Would probably require a remake to fix the game and it's honestly not worth the resources.

They aren't doing anything with the IP.

Yeah, expect nothing from this. Nintendo is just securing their own trademark.
 
This is like one of Nintendo's most boring IPs. I never understood the appeal, really. Them not making a 2nd one is okay in my book. There's like a dozen far better IP that could get a new game with a proper budget.

I disagree with the sentiment but personal taste of course plays a role here. Of course, I also think the IP has a lot of potential to be explored further. The original has aged in ways but there's very few games like it.

I'd love a remake. The original has brilliant ideas, but its graphics were beyond dated, even at release.

Please no. Nothing against the game personally but I would like to see them try their hand at a New IP instead of an established one.

I would hardly call one game that released 14 years ago an "established IP".

I would totally be up for a sequel or a VC release. Basically anything that gives us more ED.

Retro with a Lovecraft/Cthulu themed game sounds pretty awesome to me.
