California is a two party consent law when it comes to recording. File them lawsuits. Because Trump said we can sue them and win LOTS OF MONEY.

I can't really talk about Californian law, but by German law at least they could get in trouble by not showing that message before every single parts gets started/entered by someone, as of now they only show this message once when you first get the update... this is a grey area and might get either sony or whoever records your voice chat in serious trouble if a court finds this one time warning to not be sufficient enough... we will see if anyone sues someone over this in the future I guess 🤷‍♂️

Can someone enter the room monitored with CCTV, with a warning infront of the building that said all rooms are monitored by CCTV, and then demanded to not be recorded by the CCTV?

Esit : my bad. I didn't catch the one time warning. But I think if the warning says it will always be monitored/recorded, it should be sufficient

no but you have to warn people and they would get that warning every time they enter that room.
if you had that warning only up once and then remove the sign, that would be an issue.

let's say somehow everyone was using AR glasses and the CCTV warning would only pop up on these the first time you enter, and every time you enter after that it wouldn't pop up anymore that would be an issue I believe.
and that's exactly what's happening here on PS4 right now. you get a warning once and never after that... that could be an issue.
but I don't know for sure, I think this is a grey area and someone would actually have to take someone else to court for this so wer would have a precedent

If you are chatting with your friends why you should be afraid of them recording your voice?
I think that people are just afraid of being caught being assholes and so reported and banned.

As i have mentioned numerous times before ... xbox prevents party chat being streamed ( unless all parties specifically agree to it in the session).

I read the whole article. It's just cute little spin from Sony's higher-ups, i.e. "There won’t be an option to opt-out of this Voice Chat recording function because we want all users to feel safe when playing with others online, not just those who choose to enable it."

So we'll all feel very "safe" knowing a mere 40 second voice chat clip which can absolutely be taken out of context will be recorded & sent to some obscure moderation team. Lovely. They're even going to use this opportunity to (in their words) provide "guidance & education". Even lovelier.

That's still not the same as Sony supposedly "listening in on voice chats". I can see how such a system can be abused by people no doubt. But that's not the same as Sony listening in on any random conversation. I just don't see how people managed twist what is actually going on out of context like that.

It's already been clarified that this isn't quite the case. Sony isn't listening in on voice chats. They are just warning you that other users may record your sessions.

As I expected, no reason to have an abuse reporting feature, and then allow people to sidestep it through a dashboard setting. It would make it completely pointless. Those who don't like it, can always mute their mics. Spare the rest of the world your stupidity. I'm expecting this to make public chat rooms easier to deal with, which is great, since I won't have many local PS5 friends, and will mostly game online with strangers in Europe and Australia. All my US friends are half a day away now.

Their disclaimer/TOS doesn't read we aren't responsible for what other users do using our voice chat function...

Their disclaimer/TOS explicitly says; while using the voice chat function you agree your voice being recorded.

Yes, BY OTHER USERS. I understand the concern for people who might try to abuse this system, but this isn't the "Big Brother Sony" policy that many initially assumed.

I don't see the TOS mention that, do you? They use clever wording but this allows them to do whatever they like, if not now at the moment then in the forseeable future. They wrote it so that they are able to do that Big Brother stuff once you use their voice chat.

Right... just as in the Soviet Union, it was reports by everyday citizens which were sent to the commissars etc. aka state apparatchiks who would "judge" wrong-thinkers based on the evidence supplied by denouncers (they obviously didn't have a KGB or NKVD agent hiding under every bed...). That's literally how police states work. So you guys who're hiding behind a "it's not Sony who're recording!" line of defense are conveniently ignoring the fact this is a new feature specifically designed by Sony to encourage snitching & reports sent to their moderation team who'll pass judgement. They're even boasting about the "safe" environment this will create! ("safe" i.e. a total dog whistle word for SJW's in 2020).

See, THAT'S where I can understand the complaints. I can definitely see people abusing this feature, especially SJWs who feel like they're being "triggered". Sony better have a damn good moderation team if they don't want this to backfire on them.

But they did not say that, they say; By participating in voice chats, you agree to your voice being recorded. That to me sounds as Sony who's gonna play Big Brother, if not now they can easily change that in the future because the wording in the TOS leaves that option.

Except Sony Clarified later that they were in fact, not listening in on voice chat sessions.


I do agree that they should've been more specific about this from the start though.

They should've been a lot more specific and don't allow for party chats to be recorded by an in build function of the PS OS. That's creepy as have been said before in this thread. SJW's and other radicalists can get you banned for something you said in voice chat. No context whatsoever, if they were clearly baiting you before that in the chat but only send Sony your political not correct response and your account gets banned you lose acces to an account that likely has digitally bought stuff on it and that's the fear that I have the most by this. I'm affraid this policy could set a bad precedent for other (gaming) companies.

I think you may be reading too much into that. Don't get me wrong, I totally get being weary of voice features in consumer electronics, as silicon valley hasn't been the most trust worthy with that sort of thing, but that isn't what's going on here.

Doesn't the Xbox One already have a feature like this? And like I said, I can see why people are scared of this feature, since stupid people are more than likely going to try and abuse it.

As far as I know Xbox One never had the option that other users record the voice chat and to send it to Xbox enforcers.

I agree, and I do agree it's best to be skeptical about these things. I'm just saying I wouldn't rush to doomsday conclusions so quickly.

They stopped that practice last year. Also it's not recorded in voice chat sessions by users and straight sent to Sony for moderation. But voice messages a user sends to another user. Again not voice chat or group chat.

They didn't stop that practice last year, they just stopped listening in all the time. They still do the above, as stated.
Is party chat not "a user sends to another user", nor a "voice message"?
