I'll try to get him on a bit early, but the service, store and UI are still getting some finishing touches on it so we're not completely ready yet.

I don't like it, but it makes sense wanting to protect your assets especially if they are not ready to be showcased. Do what you have to do, but maybe send this guy a game or something for his troubles?

Someone ask Yoshida, " what if I post youtube videos, post pics of the UI and other information prior to launch with my leaked console? Would I get banned then? "

The answer to that would be something to see.

Do we have an alternate universe where this guy doesn't talk or stream anything to see if that's truth? lol

That's unfortunate :-( but understandable. This was one of the best threads I've followed pre-launch. Myself and others were up for hours hitting the refresh button constantly and getting all those glorious screens!
 
It shouldn't.

The fact that MS would even consider taking this out on the end user is beyond ridiculous... It was probably an automated response for consoles that log on before the launch date.

BUT STILL- It would be a retailer's fault and not the user. It's still bullshit.

How is it ridiculous? If we know the machine and service are not launching until the 22nd why should we expect access any earlier. They ban the machine from access to the service until the 22nd but he can still use the console.
 
I could certainly be wrong but I doubt there was a Microsoft employee that hit the ban button. It was probably an automated system that picked up an unrecognized account on Live that shouldn't be yet. I see Target mainly at fault here. If Microsoft wants to make sure the public begins using their service on a set date, I don't have an issue with that. Besides, if I'm not mistaken, on his twitter account he said he was just banned from using Live and that single player still worked.

They can still do the whitelist thing (if they even have such a thing), just not allow access to people who aren't on there rather than outright banning them.

I agree but at the same time this (more than likely) automated system is in place since MS had faith in the retailers.

Therefore if someone outside of the press got an Xbox One early, they probably previously assumed that it would only be due to someone stealing store inventory before launch or something similar to that.

As I said before, I highly doubt that MS saw the guy and then said "ban his console now"! There has to be a current system in place so that only the press has access to the online experiences of certain games/features right now.

So basically, if you're unjustly banned you better make a stink on twitter, GAF, get a mention of it in an Engadget article, and make enough ruckus that you threaten a console launch and then MS might look into getting you unbanned.

As I said in the other thread, one-off promises of unbannings (since he hasn't actually been unbanned yet) like this don't change anything at the corporate-level of MS which is where all of this grief they're causing themselves originates.

And LOL at, "It won't be permanent," can't get much fudgier than that.

i cant believe people think this is what should happen... Microsoft needs to take this up with Target and not with users that got their consoles few days early.

But again, this is the same type of stuff they have been doing all this year, nothing has changed at all from February onwards.

As we know MS will be sensible, the mechanism of banning the console is at this moment, a denial of XBLive until 22nd November..

It seems like some are insinuating that because he innocently bought a console super early that he is 'entitled' to access XBL and everything it offers?

Banning the console was the denial mechanism, and now that MS are sorting it out and we know it's only temporary, then I feel this vindicates the common sense position..
It's like the embargo.. sure he didn't sign one, but that's not the point, MS are defending those that did..

MS are overly draconian for sure, but I'm not convinced people understand what they are expecting of MS..

Hmm, but what about before the 15th?

That's not what the twitter user asked and all @yosp said was "no". With as tight-lipped as Sony has been about the actual console and UI, I wouldn't be suprised if someone was banned for using one - at least before Sony's big review event next week.

Pick one of the follow, ConsumerGAF, ValueGAF, GamingGAF, notwillingtobescrewedGAF, but its certainly not SonyGAF or XboxGaf, its just away for X box fans on other boards to appear condescending because their console is having a hard time and seemingly MS give the console alot of reasons for discussion.

No, a console ban and blocking usage are two different things.

One is understandable, the other is not.

Just more bad PR. As if this machine needed anymore.

And as someone mentioned, Ghosts currently has an embargo so the people who can only play it right now are probably people who have been given the a-ok (e.g.: press).

I really wish that people would stop, look at information that's already there, make logical connections, and then state what they felt happened but it's the internet and people just love spreading FUD without seeing various sides.

It seems like there was an automated system in place -- not a person at MS seeing him and then deciding to ban him.

I wish the same. Logic has flown out the window leading up to these console launches (as I'm sure it always has)!

I don't think anyone's out for blood, I think your looking at this completely wrong.

GAF is merely out for what's right & as acknowledged by the Major, having this guys console banned clearly isn't right and I'd imagine GAF's reaction would be exactly the same had this been a PS4 that got bricked pre-release.

It's good to see MS reps responding swiftly & correctly.
C'mon, most "defending" the ban stated it was likely temporary and there was not enough info to make judgement, and that it would be sorted out.

Didn't stop the pitchforks from being raised. Even had people saying that they will unban him just because they have to save face.

Please step back and acknowledge that there is a very obvious tilt in this forum. And its not all because of consumer rights.

Queue the step back / 720p digs.

And what about MS getting youtube to take down his in boxing video? Surely you don't think Coke should be able to take down your videos for having coke cans in them, right?

There are plenty of reasons, Major Nelson listed a few....but it doesn't matter in 2 weeks everyone will be playing.

They are good reason for MS to not want him online, but not good enough for his system to be ban for almost 2 weeks. Why is a 2 weeks ban okay at all?

good to hear that the situation will be taken care of, most likely i assume it will be lifted on launch day.

There are gonna be more people microsoft, you got 2 weeks errrrr 13 days before its released, the leaks will keep happening.

I understand your point but to be fair to Major Nelson, he's on record now so I highly doubt the guy won't be unbanned.

That is the part that might make an interesting court case. Him posting the info on twitter could be legally considered "publishing" it.

That's an interesting thought. I'd assume since he's not registered as a publication then he wouldn't fall into that category. Regardless since he didn't sign away his ability to talk about the product then he's pretty much safe.

That's probably true but Microsoft could've known this was going to create false positives. If they had made it so that it's clear that you don't have access to XBL till launch then all of this wouldn't have happened.

It is for me now. Never was, but here we are... And there is no 'tilt' that isn't deserved.

It shouldn't even be in his hands right now so it doesn't even matter. Just get over it, we had some great updates last night but the fun is over. The guy will get a working console, still earlier than the rest of us.
 
There should have never been a ban. There should have been a message when the user tries to update saying, "Sorry, this update isn't available until November 22nd."

MS can isolate IP addresses that need those updates.

This is simply sloppy on MS's part.

I'm happy that Major Nelson has reached out to the guy, but he shouldn't have had to do this. It shouldn't have come to this.

Folks, Xbox Live and likely the OS isn't even final. Connecting to Live could cause all sorts of problems. Not allowing the console to connect to Live is within MS's right and it's probably the right thing to do. I see nothing wrong with restricting someones access to a non-final build of the service.

Based on youtube's current policy, they probably could have such videos taken down. I doubt they would though.
