So Target shipped someone an Xbox One already? [Update: console-banned until launch]

I'll try to get him on a bit early, but the service, store and UI are still getting some finishing touches on it so we're not completely ready yet.

Larry, can I call you Larry? You are missing the big picture here, you know for a fact that you could get his console un-banned immediately. Microsoft's policy of shoot first ask questions later needs to stop. This is the perfect opportunity for the company to reverse course, since we are going into a new generation. Banning people for playing a game early when they received the game legally is beyond ridiculous.

I can sympathize with the fact that everything may not be ready currently, but that is honestly a moot point is it not?

1) Making a DMCA claim on Youtube is making a copyright claim. Making a copyright ownership claim over a video they didn't make is FRAUD.

2) No just because there's a street date (an agreement between a manufacturer and retailer, not a law) on a product does not give them "more rights and control over it." The consequences of breaking the street date fall entirely upon the shoulders of Target, who made the agreement with Microsoft. Once Target gave the product to the user, that user owns it, period. The user can take pictures of it, record video of it, or go all office space on it. It's theirs. It already passed from Microsoft's hands when they sold it to Target, and from Target's hands to the user. If they want it back so badly they will have to strike an agreement with the user (i.e. buy it from them).
Most copyright infringement claims relating to gaming are over videos that the copyright owner did not make so I'm not sure you think that is a valid point even for a person not well-versed in the topic. The second point doesn't even have anything to do with what I was saying. It is a fact that until product or work is published/made publicly available, the copyright owner (or IP owner) retains more rights and control over it. Just because there is a third party involved who made a mistake does not mean those rights have necessarily been forfeited. I'm not an IP lawyer and I do not know the basis of their claim, so I've no idea whether this claim could succeed in a court, but rather I am suggesting that these issues are much more complicated than you seem to believe.

This is a good spot, they probably forgot to change the date of the standard edition so when they took the shipment on Monday it automatically went in stock on the site and started shipping.

Sounds reasonable.

You mean, not shown to the public in the unboxing by the Major and the 12 minute edited demonstration of the UI? This isn't about leaking anything, it's about wanting to control the messages the consumer communicates - and that is messed up.

So i'm guessing Microsoft ultimately decided they needed more time to finish up the Live backend. It's crazy that the system is complete and the update ready to go, but they have to wait now since, in my opinion, Live was not ready and they can't launch in the same week as the PS4.

No, but I know what company it's for and they help at various other retailers with game related things (Walmarts and Bestbuys and a few other places)

Cant remember if mentioned but if i buy a retail game but decided to sell that game and buy the same title but off the xbox marketplace would the save still carry over?

Yes. The only difference between them is the form of distribution.

FYI, it has also been stated that if a friend comes to your house and plays a disc game on your console that you'll be able to buy that game via the marketplace without having to install again.

To above posters' questions about per bans: MS has a statement Engadget stating that they will be providing access to live on the 22nd.

A Microsoft spokesperson tells Engadget that the Xbox One consoles some consumers received by accident well ahead of launch on November 22nd cannot access Xbox Live until closer to launch. The statement says: "Due to a retail partner's system issue, a very small number of Xbox One consoles were shipped to consumers before the November 22 street date. We're pleased to see the initial response to Xbox One has been so positive, but given we are still putting the finishing touches on our games, UI and online services, as well as confidential partner and media agreements, these consoles units will be restricted from connecting to Xbox Live until closer to our launch date."

Agreed, but two points. First, I want to wait until the 22nd and see if he REALLY gets unbanned. Second, why the hell wasn't MS prepared for just such a circumstance? They really got caught with their pants down with this.

The console and service launch on the 22nd. You can leak whatever info you want - you just can't connect to Live. Otherwise, Microsoft would be sending cease and desist letters to all the sites that have re-posted all this guy's info/leaks.

Yup and if you didn't delete the installed game, it will just unlock - no need to redownload.

great, the install unlock is a nice bonus too :)

Now that everything's region free 100% with disc games and not 50/50 like with the xbox 360. Hopefully nearly all dlc will be region free. Not expecting the japanese one though, maybe EU --> NA dlc/disc and vice versa.

Gotta say, MS's response is about as good as can be expected. At least they will be returning Live Access to him earlier than launch.

My stereoscopic vision is working fine, it's bigger than the original ps3 and that was too big. My preference though.

I don't actually get the "see the thing in person" comments. The thing is almost as big as a PS3 FAT, and there ain't nobody alive today that says the thing is at all small in form factor. It's massive.

I've seen it in person, they're on kiosks. It's still massive. It's just a bulky device. No harm in it, few people actually care if their videogame system is big.
