1) Making a DMCA claim on Youtube is making a copyright claim. Making a copyright ownership claim over a video they didn't make is FRAUD.

2) No just because there's a street date (an agreement between a manufacturer and retailer, not a law) on a product does not give them "more rights and control over it." The consequences of breaking the street date fall entirely upon the shoulders of Target, who made the agreement with Microsoft. Once Target gave the product to the user, that user owns it, period. The user can take pictures of it, record video of it, or go all office space on it. It's theirs. It already passed from Microsoft's hands when they sold it to Target, and from Target's hands to the user. If they want it back so badly they will have to strike an agreement with the user (i.e. buy it from them).

Most copyright infringement claims relating to gaming are over videos that the copyright owner did not make so I'm not sure you think that is a valid point even for a person not well-versed in the topic. The second point doesn't even have anything to do with what I was saying. It is a fact that until product or work is published/made publicly available, the copyright owner (or IP owner) retains more rights and control over it. Just because there is a third party involved who made a mistake does not mean those rights have necessarily been forfeited. I'm not an IP lawyer and I do not know the basis of their claim, so I've no idea whether this claim could succeed in a court, but rather I am suggesting that these issues are much more complicated than you seem to believe.

This is a good spot, they probably forgot to change the date of the standard edition so when they took the shipment on Monday it automatically went in stock on the site and started shipping.

So i'm guessing Microsoft ultimately decided they needed more time to finish up the Live backend. It's crazy that the system is complete and the update ready to go, but they have to wait now since, in my opinion, Live was not ready and they can't launch in the same week as the PS4.

No, but I know what company it's for and they help at various other retailers with game related things (Walmarts and Bestbuys and a few other places)

Yes. The only difference between them is the form of distribution.

FYI, it has also been stated that if a friend comes to your house and plays a disc game on your console that you'll be able to buy that game via the marketplace without having to install again.

Now that everything's region free 100% with disc games and not 50/50 like with the xbox 360. Hopefully nearly all dlc will be region free. Not expecting the japanese one though, maybe EU --> NA dlc/disc and vice versa.

Sounds like they have just disabled any unauthorized Xbox One's ability to connect to Live. Look a few posts above yours at Major Nelson's. It's not a full on ban like people are thinking.

I don't actually get the "see the thing in person" comments. The thing is almost as big as a PS3 FAT, and there ain't nobody alive today that says the thing is at all small in form factor. It's massive.

I've seen it in person, they're on kiosks. It's still massive. It's just a bulky device. No harm in it, few people actually care if their videogame system is big.
