Jussie Smollett paid two brothers $3,500 to stage an attack on him last month, taking "advantage of the pain and anger of racism to promote his career," Chicago Police Superintendent Eddie Johnson alleged Thursday.

The revelations necessary to charge Smollett came during the 47th hour of a 48-hour holding period for the brothers, who eventually confessed to the alleged plot, Johnson said. Had they waited another hour, the superintendent said, authorities would have been forced to release them.


"We just didn't have the total package to support that it was a hoax," he said. "This investigation didn't turn in the direction of Mr. Smollett being a defendant until the 47th hour that we had those two individuals in custody."

The "Empire" actor was arrested Thursday morning on suspicion of filing a false report about the January 29 incident and appeared in court in the afternoon.

With his family members standing throughout the proceeding, Smollett wore the same puffer jacket he wore in his police mugshot. He shook his head and closed his eyes as prosecutors outlined their case against him: that the actor directed the brothers on what to say and do -- including uttering a racial slur, employing a noose and making a reference to "Make America Great Again."

Smollett texted one of the brothers, his friend Abimbola Osundairo, on January 25 and said, "Might need your help on the low. You around to talk face to face?" prosecutors alleged.

After laying out the plan and rehearsing it, prosecutors says, Smollett then gave Abimbola Osundairo and his brother, Olabinjo, a $100 bill to buy clothing and rope for a noose, prosecutors allege. He also instructed them not to bring their mobile phones to the attack, according to prosecutors.
Smollett spoke in court only to confirm his name to the judge. His defense team told the court that Smollett was not a flight risk and cited his philanthropic work in making his case for bail. The judge granted a $100,000 bail, and Smollett paid a $10,000 bond. He was ordered to give up his passport and will remain under supervision until his case is adjudicated.

Smollett faces a felony charge of disorderly conduct for falsely claiming he was attacked by two men on January 29 in Chicago, police say. The attackers yelled racist and homophobic slurs, tied a rope around his neck and poured an unknown substance on him, Smollett alleged.

Smollett's camp has released no statements since he turned himself in, but his attorneys previously promised an "aggressive defense."

"Mr. Smollett enjoys the presumption of innocence, particularly when there has been an investigation like this one where information, both true and false, has been repeatedly leaked," they said in a statement Wednesday night.
The attack took place but was staged, Johnson said. The brothers punched Smollett a little, wearing gloves, according to Johnson.

"As far as we can tell, the scratching and bruising that you saw on his face were most likely self-inflicted," said Johnson.
Investigators believe Smollett staged the attack "because he was dissatisfied with his salary," Johnson said, citing information that the brothers gave to police.

Police initially treated the attack as a hate crime and were able to track down the men, in part, through cabs and rideshares that they took after the attack, Cmdr. Edward Wodnicki told reporters. By the time police identified the men, they had hopped on a plane to Nigeria, but their itinerary said they were returning February 13.

Investigators continued their investigation -- obtaining phone and social media records, among other evidence -- and met the brothers at customs when they returned to the country, Wodnicki said. Phone records indicate Smollett talked to the brothers about an hour before the alleged attack, an hour afterward and after they had left the country, authorities say.

According to Johnson, Olabinjo and Abimbola Osundairo asked for an attorney once in custody. After their lawyer explained to police that "something smelled fishy," the men told officers that Smollett, who is black and gay, first "attempted to gain attention by sending a false letter that relied on racial, homophobic and political language. When that didn't work, Smollett paid $3,500 to stage this attack," the police superintendent said.

Seven days before the alleged attack, a letter was sent to the Chicago set of "Empire." It contained white powder and a drawing of a "stick figure hanging from a tree," police have said.

Authorities determined the powder to be aspirin, police spokesman Anthony Guglielmi said. According to prosecutors, Smollett told Abimbola Osundairo that he was disappointed in the "Empire" team's reaction to the letter.

Investigators have the check Smollett used to pay Abimbola Osundairo, prosecutors say. Though Johnson said the payment was $3,500, he also said Smollett agreed to pay the men $500 when they returned from Nigeria. It isn't clear if that sum is included in the $3,500. The brothers' motive for helping was money, Johnson said.
"There was never a thought in their mind that we would be able to track them down," he said.
Pretty big update, probably next will be when this goes to court or if Jussi decides to go on the lamb.

Harrowing details emerged in the Jussie Smollett case on Monday, nearly a week after the "Empire" actor told police that he was brutally attacked in what authorities are calling a possible hate crime in Chicago.

An initial incident report, released by the Chicago Police Department on Monday, revealed that a 60-year-old friend of Smollett called the police on his behalf and said the actor "did not want to report offense however he believed it to be in the best interest to."

Once they arrived, responding officers said they found Smollett at his home with stained clothing and "white rope draped around" his neck, according to the report, which ABC News obtained via a Freedom of Information Act request.

Smollett, who portrays a gay musician on Fox's "Empire," said the attack happened last Tuesday at around 2 a.m. as he was leaving a Subway restaurant. He told police that two attackers gained his attention by yelling racial and homophobic slurs and began to beat him "about the face with their hands," the report said.


They used their hands, feet, and teeth as weapons in the assault, according to the report.

"The primary aggressor was wearing a black mask concealing any facial features and both offenders were dressed in black," according to the report. "The victim does not remember any other distinguishing features of the offenders, or in which direction they fled," it added.

Although Smollett was unable to identify his alleged attackers, he did provide officers with an approximate height and weight for one of the assailants.

The incident report goes on to detail what the 36-year-old actor and singer told officers about the alleged assault, including information about a noose being placed around his neck and an unknown chemical, possibly bleach, being poured on him.

The report also confirmed that Smollett told police that he received "hate mail at his place of work" on Jan. 22, a week before the alleged attack took place.

The report surfaced just hours after Chicago Police Department spokesman Anthony Guglielmi tweeted that investigators located "additional security cameras" that could help with the manhunt for suspects.

"Detectives continue to follow-up on investigative leads as additional security cameras have been located and footage is being downloaded and reviewed," Guglielmi said. "The people of interest have not been identified (as homeless or otherwise)."

Smollett returned to the stage for the first time since reporting the attack at a performance in California over the weekend.

"I'm not fully healed yet ... but I'm going to be, and I'm gonna stand strong with y'all," he told the cheering crowd.

He said his family and friends had urged him to cancel the performance, which was scheduled before the alleged incident, but he declined.

"I had to be here tonight, y'all. I couldn't let those [expletive] win," he said. "Regardless of what anyone else says, I will only stand for love and I hope that you all stand with me."

According to an initial police report obtained by Fox News, the 36-year-old Smollett, who is black and openly gay, told officers that he was accosted while walking to his apartment by two men who called him an "Empire f----t [n-word]." Smollett then said the men beat him and poured an "unknown chemical substance" on him, staining his clothes. The report said that when responding officers arrived, Smollett had a white rope draped around his neck, but the report did not specify whether his alleged attackers put the rope there.

The report also says that Smollett initially did not want to report the alleged attack, but his manager did so because "he believed it to be in the best interest."


That area of downtown Chicago has many hotels and restaurants and has widespread surveillance-video coverage, and although police have found footage of Smollett making his way home — including video of him arriving at his building with a rope around his neck — they haven't found footage of the attack or men fitting his description of his attackers. The police report said both men were dressed in black and one of them, referred to as the "primary aggressor," was wearing a black mask.

Chicago Police Superintendent Eddie Johnson said during an appearance on WLS-TV Friday that Smollett has been "very cooperative and we have no reason at this point to think he's not being genuine with us." For his part, Smollett insisted in a statement Friday that he had been "100 [percent] factual and consistent on every level.

Two Nigerian brothers told Chicago police investigators that they were paid by "Empire" actor Jussie Smollett to stage an attack on him, according to a person familiar with the situation but not authorized to speak publicly.

The person, who asked not to be identified because of the sensitivity of the ongoing investigation, said police are attempting to interview Smollett again, so they can question him about the brothers' account.

Smollett, who is black and gay, said he was attacked while walking home through Chicago’s Streeterville neighborhood late last month. He told police masked men tied a noose around his neck, poured bleach on him and yelled homophobic slurs and “MAGA country!”

Police also found records in the Chicago home of one of the men that showed they purchased rope from a hardware store that was used in the alleged attack, the source told USA TODAY.

"We can confirm that the information received from the individuals questioned by police earlier in the Empire case has in fact shifted the trajectory of the investigation,” the Chicago Police Department said in a statement. “We've reached out to the Empire cast member's attorney to request a follow-up interview."

Police had questioned the two brothers earlier this week after taking them into custody at O'Hare International Airport upon returning from international travel. They initially classified the brothers as suspects in the Jan. 29 attack on Smollett.

Late Friday, the men were released from custody without charges. Anthony Guglielmi, Chicago police's chief spokesman, cited "new evidence” as the reason for the men's release.

An attorney for Smollett did not immediately respond to requests for comment.

Earlier this week, Chicago’s ABC affiliate reported that investigators believed that Smollett staged the attack, because he was being written off the show.


FOX Entertainment and 20th Century FOX Television, which produces the Chicago-based family drama, pushed back against the notion that Smollett was being written off the show.

“The idea that Jussie Smollett has been, or would be, written off of 'Empire' is patently ridiculous. He remains a core player on this very successful series and we continue to stand behind him,” the statement said.

Since launching the investigation, police consistently described Smollett as a victim of an attack.

Asked by USA TODAY Saturday if investigators still believe Smollett was a victim of an attack, Guglielmi stopped short of categorizing how investigators currently view the actor.

"We have some new information that we would like to corroborate," he said.

Smollett said in an interview Thursday with ABC's "Good Morning America" that those doubting him "don't even want to see this is the truth."

"It feels like if I had said it was a Muslim, or a Mexican, or someone black, I feel like the doubters would’ve supported me a lot more, and that says a lot about the place that we are in our country right now,” he said.

This is just more proof that the "MAGA" slogan is alot more than harmless to some people. There is no way to dismiss this incident as being harmless.

I have already stated before that not all people who wear MAGA hats or support the slogan are racist. It just seems that alot of racists seem to wear MAGA hats or support the slogan. Yet somehow that doesn't seem to concern alot of people here?


We have widely publicized examples of the MAGA hats and the slogan being associated with racism. And this is just another example of why that is. Yet the focus is ALWAYS....FUCKING ALWAYS on the idea that "not everyone who wears the hat or supports the slogan is a racist". Yeah thats cool and thats fine not all of them are racists I agree with you on that, but that doesn't magically make the fact that actual racists DO support the slogan and the hats disappear.



They exist. They are real. And as @7echnicolor just pointed out this is not an isolated incident and yet people from the Right endlessly try to pretend that they are fake or that its just the "mainstream media" spinning up lies.

I have already stated before that not all people who wear MAGA hats or support the slogan are racist. It just seems that alot of racists seem to wear MAGA hats or support the slogan. Yet somehow that doesn't seem to concern alot of people here?


We have widely publicized examples of the MAGA hats and the slogan being associated with racism. And this is just another example of why that is. Yet the focus is ALWAYS....FUCKING ALWAYS on the idea that "not everyone who wears the hat or supports the slogan is a racist". Yeah thats cool and thats fine not all of them are racists I agree with you on that, but that doesn't magically make the fact that actual racists DO support the slogan and the hats disappear.
So what do you want to do about it? Yes, there are racists that wear these hats, but there are also a lot of good law abiding Americans that do as well. There are just as many stories, if not more, of people wearing Maga hats getting assaulted.

So again, I ask, what would you like done about this?

It would be nice if Trump supporters would actually admit that their hats and slogans are being widely used by violent white supremacists and that the racism that is associated with them is not unfounded like so many try and claim.


That would be a good start.

Many of them have nothing to do with racism or xenophobia. They are just the acts of unhinged idiots. I could run out of text if I cataloged all of the times a black person, a Muslim, a member of the LGBT committed a crime. I would also hopefully be banned.

If you want to paint groups of people for the actions of a few be my guest. I don't think it ends well for anyone.

The only place mentioning the "MAGA" line is TMZ though. None of the other news organizations I read earlier mentioned this at all. Even the alternate source in the OP don't mention it, aside from People that said it was not verified.

The difference being...those people didn't choose to be those things, and they don't commit crimes on behalf of that part of their identity. LGBTQ folks aren't out there stabbing folks with rainbow-colored knives, lol.

White supremacists thought they could rise out of the shadows under Trump, and Trump goaded them on because he wanted their votes to help beat Hillary.

This ultimately lead to the unite the right rally, and it took that (they changed their strategies due to backlash), and deplatforming to cool their run.

There can be supremacists everywhere, and nowhere at the same time. The greatest impact that they have now is making someone they hate their target. That behavior should always be condemned. MAGA encouraged this, and thankfully it's run was short.

MAGA also encouraged a lot of other poor behavior, that was always there, but when the president doesn't condone you for it and use the jargon, it accelerates.

I noticed that too. I will update the OP if that turns out to not be the case, but as others have stated already it wouldn't exactly be a shock if it was true. Also its led to a rather productive discussion I think on the validity of the negative connotations of the "MAGA" slogan as a whole.
