Nintendo Takes Down 101 Character Mario Kart Video

Back in February 2016, a popular Youtube user called ‘Hat-Loving Gamer’ posted an interesting Super Mario Kart video. Namely, it was a crossover where 101 different video game characters were racing through Mario Circuit in Super Mario Kart. And dear god, it was impressive. The Koopalings were there. Rayman, Sonic and Bioshock had characters included from them in the animation.

What the freaking hell is wrong with the idiots at Nintendo? This wasn’t a hack. This wasn’t linked to any sort of playable game. Heck, do you honestly thing the SNES could actually run a game with 100 playable characters at the same time? Really? You made the damn console, you know what it’s capable of.

In simple terms, this was a parody. Parody videos are legally protected. Don’t like that? Tough crap.

Aside from the actual legality of this and whether or not Nintendo was in the right (Which they completely were, if not maybe the wisest of their decisions), that article is absolute garbage.

They could not come off more fanboyish and entitled if they tried.

Wtf??? This makes ZERO sense and I never would have assumed it would be taken down. It's not even a game mod to play.

It wasn't a rom hack or anything, just a fan video. I do not see how Nintendo had any right to take this down?

As much as we all want to believe that parody is a magical defense that allows us to use normally protected characters all willy nilly, it really isn't.

Parody only falls under fair use if the creator can prove that it's a commentary on the original work that it's parodying.

If it doesn't, then it's up to the copyright holder on whether or not they want to allow it.

Do I personally think Nintendo should have taken the video down? No. But I can understand how they had the right to do so.

Nintendo fighting hard to preserve their out-of-touch old-man reputation. They lost a lot of that by releasing a modern online shooter, but it's good to know that this stalwart of video game publisher conservatism has not gone under.

Wouldn't be surprised to see Super Mario Bros Z on the chopping block either. And Earthworm Alvin just rebooted the series recently.

Unfortunately, Dorkly videos will still exist.

It's a copyright claim; those are issued manually and are totally separate from ContentID.

Plus the YouTube video straight up says such

Once it was revealed that he didn't work for the company the message was changed to

Nintendo can't have people thinking that something more impressive can be done with their old content. Think of all the virtual console money they might lose! How will they sell you another Nes remix whatever?

Given the long history of precedent do you really think there's a good chance this isn't Nintendo?
 
When things like Racist Mario and Star Bomb songs about Nintendo franchises are till up? Yeah, I think there's a decent chance it's not Nintendo.

One uses in-game content, the others don't--just like almost every other video we've seen Nintendo pull down.

It's Nintendo. You're in denial if you think it's likely not Nintendo

Yeah, he even had a patreon about making more Mario Bros. Z episode but Nintendo took it down, he made a new one "digital art and animations" while not mentionning anything Nintendo at all while making the next episodes and he seems to be fine so far
