One thing I don't really understand is why she's being given so much credit for the game. Last time I checked, Assassin's Creed had a team of 80+ people. I'm pretty sure she didn't do the animation. Or the sound effects. Or the code that makes the controller rumble when you get hit. Yet over and over again we're told that this is Jade Raymond's Assassin's Creed. She's the driving force. The visionary.

Also, this law firm should be punished. The image is clearly not libelous. Libel requires two things: 1) to be a factual assertion rather than an opinion, and 2) to be made maliciously rather than as commentary, review, or satire. This image clearly does not support either.

These lawyers have sent out the letter in an effort to get the content removed. They are representing themselves as lawyers while doing it, and alleging that this sort of thing is against the law. It is not. The lawyers should be sanctioned or disbarred along with any other lawyer who wields the power of the law in a knowingly incorrect way. Lawyers have the legal right to act in a specific capacity; in exchange, they should also have the legal responsibility not to abuse their power. This is not merely wrong, it is frivolous. There is prima facie no evidence.

Furthermore, even if this image was somehow libelous, they're sending the C&D to the wrong person. Owners of communities are not legally held liable for the content created by their users. The users are. The C&D should be being sent to WaffleImages.com, which is an image hosting site, or it should be sent directly to the person that uploaded the image. Courts both in the US and abroad have repeatedly ruled to this effect.

Number 1: It is not a parody of an IP. A human is not an IP.

Number 2: It doesn't matter whether they used her full name or not. Courts don't care how much of a name you use, just whether or not it's clear who you're defaming. It's clear in this case.

Yeah exactly, that Ubisoft letter only made it worst. It doesn't change the fact that it must suck bad for her right now, stop trying to say it doesn't, wow.

It's a comic strip. She is a celebrity in the video game world, so how is this different from any other comic strip of this nature about a celebrity? I've seen crap like this about other celebrities before.

Neither are you. Parody is parody.

Plus, the comic is meant to be commentary on how people will buy the game solely because they are into Jade, even though the comic is poorly done.

The Smash: Last night at the Assassin's Creed shindig, producer Jade Raymond personally told Guest Editor Geoff Keighley that those rumors were totally untrue and that she's never do something like that. She actually seemed somewhat offended people thought she would. Ubisoft PR got so many inquiries about it almost had to issue and official statement. So, while this rumor so SMASHED, please don't rule out Creative Director Patrice Desilets' Maxim spread!

My problem* here is although we always view people like Miyamoto, Jaffe, Balrog, Molyneux, Itagaki etc as "the minds behind the games" and some of them have big egos sometimes. I've never seen them do something as "extravagant" as the picture posted above with Jade standing out so much from the rest. I'm not saying it's a bad thing but she put herself out there to much, and no she shouldn't be treated badly for that. Just saying.

We know she's the face of the game but it's a bit much I think. But I mean people make fun of the others as well, Jades is "worst" because the easiest thing for her to be attacked with is her gender.

Edit: And she's putting herself in Maxim as well? *sigh* hard to argue this one that much I guess.

Edit: So it's false? I take back what I said.

This is to far in my opinion. And no I've never liked Jade -_-

This will never see a day in court, but just for the sake of the argument:

Defamation is defamation. If CBS ran a TV show where they alleged that an actress used sex to obtain starring roles, they woudl be open to a serious defamation lawsuit.

I was thinking more along the line that Ubisoft could say they used the name Assassin's Creed in a defamatory way

After you read it, explain to me how that comic is a parody of an existing franchise. It's certainly not a parody of Assassin's Creed. What is it a parody of?

And as a matter of fact, this case would not be about parody. The word parody would never enter in to it. It's a defamation case, if anything.

Besides the original comic not having a point to other than to defame someone, the reply by PA is utterly tasteless. I'm with Ubisoft on this one. Oh yeah, PA continues to suck as it always has.

I feel sorry for Jade for getting so much juvenile and unwanted attention (including on this forum). But on the other hand, it's not like it should come as a shock or surprise that she does get it.

There's a precedent of this in DiMeo III vs Max, where this NYC hotdog tried suing the owner of a forum over derogatory comments made towards him by forum members.

He lost spectacularly, to the point where the judge issued what can only be described as a legal bitchslap.

Doesn't really make sense to sue SA when they didn't even make the comic. One of their members just posted the image on the forums. I'd say that doesn't really hold that much grounds to a case, or would I be wrong...?
