Jim Sterling is being sued by Digital Homicide

Never liked Jim (too egotistical for my liking) but this is stupid.

Not that I expect to change your mind, but I used to think this as well until I saw him outside the context of The Jimquisition and realized the version of him on the show is a character. I mean, in retrospect, I feel like maybe I should have realized this on my own because he's like a bloody Saturday morning cartoon villain on the show. Either way, from everything I've seen of him outside the show, he seems like a really cool dude. That made enjoying The Jimquisition a lot easier for me too.

That might be the perfect GIF for this situation.

Wait...Jim's real name is STANTON?!?

...everything I know is a LIE!!!

He mentioned in one of his videos that it is being changed for personal reasons but it isn't going to be officially changed until he gets his citizenship just to make things less compicated. (Hope I remembered that right)

i bet they think that they have legal standing because they "warned" Jim to leave them alone but he didn't, so that means they can sue him.

it's no different than, say, Ubisoft black listing Jim from getting review copies of games, and him just buying a copy and reviewing it anyway. Ubisoft can't sue him for reviewing it or saying bad things about it.

likewise, if DH's stuff is available for legal consumption there's no legal reason he can't obtain those things and then criticize them. JFC ARE THEY THAT DUMB?

My concern is that US law (to my understanding, correct me if wrong) does not have cost awards. That is to say, the winner (Jim) will still be responsible for paying legal fees, which could hurt him fairly significantly. As people are saying, Jim will wreck these guys but it may cost a pretty penny to do so.

As Robert is saying, they may be hoping to settle with Jim not paying anything but agreeing not to talk about them anymore, dangling the idea of Jim having to potentially go to trial and pay legal costs for that as their backing even if their claim doesn't have a chance at winning, but could have some sort of merit worthy of trial.

DH: He called our games shit.

Judge: Anything to add defendant?

Jim: I have hours of documented material that prove these games are indeed shit.

Thank God for me

I like the idea that they believe they can sue Jim for violating Fair Use because they think he's unfair.

That is rather special.

You can countersue to recover the cost of legal fees. If Jim's laywer is competent at all, that lawyer is drafting the paperwork for that right now.

I was checking Digital Homicide's Twitter and was wondering why they had so many followers. Going through them, it seems like 90% is just bots so they probably bought followers to make themselves look better lol.

Seriously, Digital Homicide:

Those games have made a terrible name for themselves in the industry.

Saddly there is a group of complete idiots that will follow Sterling regardless if the information is true or false. Those are the ones that sent those messages to DH.

What DH is doing just will fuel those fans and the situation will end worse than now.
Specially when DH has that background

Amazing. So if Jim wins his legal fees will be covered or how does this work? Because otherwise that's gonna be a really expensive laugh.

EDIT: Ok just saw the post above. Ouch.

Hey, didn't you see the other thread? We hate Jim now. He was being too critical or liked his hat too much or whatever.

Time to root for Dirigible Homophone.

Not automatic cost awards, but they are available in certain situations.

This was the video that made me really admire who Jim is as a person. I've always really liked him and his character on The Jimquisiton, but this just made me appreciate him as a person.

Who exactly do they think is big enough into Digital Homicide that they'd help for the bill for this suit? Is there anyone outside of Romine himself and maybe that guy who sat in with him for the interview who isn't on Jim's side?

Jim winning the case doesn't necessarily mean he'd immediately recover the cost of his defence, but there are a number of ways that can happen, including the above-mentioned countersuit. Hell, depending on the laws of the jurisdiction he was sued in, it's entirely possible that the judge themself can award the legal fees to Jim.

EDIT: It wouldn't surprise me if libertarian lawyer/blogger Ken "Popehat" White picks up on this soon, he's already familiar with the background of the matter.

If DH thought there was a chance they would lose, do you think they would still go forward? I don't care either way as I think both sides are retarded. Just find it funny this will likely end with both wasting their time and money.

I bought that stupid baby game for 99 cents and got an email wanting me to donate to this trash

I forwarded it to PayPal as a phishing attempt

Maybe Jim ends owning their IPs as payment

Hope Jim finds some way to record this, for history purposes.

This guy from DH is delusional if he thinks he's gonna win this.

If he ever wins, I'm gonna eat the biggest, dirtiest crow that exists.

This is probably the most nonsense use of "both sides" I've ever seen, and that's saying something.

I can see DH points if

  • Stealing artwork
  • Stealing assets
  • Of illegally using another companies name
  • Conducting illegal business activities
  • Impersonating someone

are untrue. Slandering someone is no good. But honestly I can't get a grasp on the whole situation at a glance sooooooo

wow this podcast jim did with the guy from dh is INCREDIBLE

Haha, kudos if you can finish it. I think I went through the majority of it, but the levels of wtf from Digital Homicide were gargantuan IMO. I mean, majority of the time I was listening to it I'm sure I was making facial expressions that looked as if I had stomach cramps or something.

reading up on this and watching the youtube videos I can't stop laughing. I feel sorry for Jim that he has to waste his time with this bullshit, but it's quite the entertainment
