WASHINGTON - The Supreme Court refused Monday to consider whether a Texas law making it a crime to promote sex toys shaped like sexual organs is unconstitutional.

An adult bookstore employee in El Paso sued the state after his arrest for showing two undercover officers a device shaped like a penis.

The employee, Ignacio Sergio Acosta, says a Texas law outlawing the manufacture, marketing or dissemination of devices shaped like sex organs is unconstitutional because it prevents individuals from using such devices, violating their right to sexual privacy.

Colorado, Kansas and Louisiana have held such laws unconstitutional, while Georgia, Mississippi and Texas have upheld them, said Acosta's lawyer in urging the Supreme Court to take the case.

An El Paso County court granted Acosta's motion to dismiss a criminal complaint against him, but an appeals court reinstated it, saying the Texas law did not infringe on private sexual behavior.

Acosta also said the Texas law should be examined in light of a U.S. Supreme Court decision that struck down a Texas criminal law banning gay sex as an unconstitutional invasion of privacy.

Crap like this and the story of the comicbook store guy who was arrested because a cop thought Urotsukidoji was obsene (and that's not the stupid part, the stupid part is the jury that refused to declare him not guilty) makes me feel sick that I live in Texas. Isn't there any way to knock some common sense into our legislators?

At least we made progress with the Supreme Court struck down the sodomy law but i'm flabbergasted that they refused to hear this one out since it is such an obvious violation of a genuine human right.

What's this law based on? Who is being harmed? I am from Texas and I miss it sometimes, but these odd laws seem like that they are designed to win votes from some religous group or something. No one could seriously think a dildo is harmful.

I agree to an extent.

It just goes to show how ridiculous our state laws are then. We bitch about frivolous federal laws when we have a law banning dildo's. We have social and economic issues that are passed around like hot potatoes, but God forbid a soccer mom buy a plastic dick to stick in her ass.

where is this genuine human right? did I miss the passage in the constitution where you are guareneted the right to have a dildo?

This isn't a judicial issue, this is a legistlative issue

I dunno, ask the legistlature. Personally, I think its stupid - but this isn't a case for the supreme court - unless you can make a due process argument, there isn't much here for the courts.

Ya it seems a little heavy handed to me when your government feels the NEED to ban people from owning plastic sex toys. What kind of right do they have to determine whether you are entitled to owning something like this or not?

I've lived in Texas for awhile now and never knew abut this law. Here in Dallas i guess it just gets ignored. You can walk into any porn store and see all kinds of sex toys and instructions on how to use them. They even have viewing rooms. >_>

They sell dildos all over Texas. I have been into porn shops and head shops in Dallas and Austin that have them, and they are out in the open. If this is a law, it is only enforced in certain places. Actually, all the article says is that it is illegal to promote them. So I guess advertising and vocal promotion is illegal. You cannot say, "This is a dildo, I higly recommend it!"

I’ve read the Ten Commandments, the Declaration of Independence, the US Constitution and the Bill of Rights, the Kentucky and Virginia Resolutions, and even the godless communist Declaration of the Rights of Man—and no where in any of them did I ever see sexual perversion and degeneracy labeled as a “human right.”

I’m sorry, you have a right to bear arms, a right to life, liberty and property—but you don’t have the right to be a pervert.

And frankly as a Texan and American you should be pleased that the US Supreme Court upheld its constitutional duty—a rarity these days. The SCOTUS has no power under Article III of the US Constitution to even rule on this case.

Ok, so is it an infringement on free speech, then? It seems stupid that you can buy, own, and use something completely legally but can't talk about it to some interested individuals. I mean, if they were trying to sell one to kids I could see being uppity about it, but talking about it to a person who's old enough and who may be looking for one? Why?

Lots of room for debate on how those rights are determined by the courts. I tend to favor the more expansive view. Unless the government can show a solid social benefit, it shouldn't be regulating sexual pleasure.

You're misunderstanding what a right to property means and turning it into what you want it to mean for the purposes of your argument.

It does not mean you can own anything you want, it means that an individual—not just the state or the local sovereign--can actually own property—that it’s yours and nobody else has any legal claim to it.

Banning the possession of certain items doesn't go against a right to property at all.

This is not a general law, this is a Texas law--and unless it has to do with slavery or a general ballot--the US Constitution has nothing to say on the matter. Well the fact of the matter is the Constitution doesn't afford you the right to be an Eagles fan in Texas. Don't get apoplectic about it, just read the Constitution. The US Constitution isn't some worthless European "Let's put every pet issue we have and codify it in our founding document!" constitution. The US Constitution is a true governing document, a contract with the states outlining the agreed upon powers of the general government.

So don’t look to the Constitution for “rights” look to it if you ever forget which branch of the government can pass bills about tariff policy.

Just curious Browds, on what grounds do you justify dildo bans? Isn't it the store owner's prerogative if he or she wants to sell a sex aid device? It's between the owner and the customer, no force or fraud involved.

I don't see why it is the government's job to tell them they can't go through with the transaction.

Also, how do you come off saying that the item in question is "sexual perversion and degeneracy." Aren't those moral abstracts?

And what does the Ten Commandments have to do with anything as this isn't a religion thread and the concept of "rights" have nothing to do with the Ten Commandments outside of Christianity.
