So Target shipped someone an Xbox One already? [Update: console-banned until launch]

It seems, from an uninformed viewpoint, they were upset at the YT competition they had going on with some random fan that didn't follow the UI script they created in their video.

You already have it in your first sentence.

No, no, he really doesn't. Street dates are for retailers, not consumers. There is nothing in the documentation about not using something before a street date. That's an arbitrary assignment. Once the gatekeeper releases it, the consumer legally buys it, then it's the consumers to use.

I guess, if your GT gets banned on Xbox One it's also banned on your 360, right? Terminating your entire library of digital licenses across two consoles should your hardware ever fail. Now, that's a comforting thought considering that MS probably can ban you for a wet fart in front of your Kinect 2.0.

Again, read what happened. The guy can still use his 360 and xbl on it. And he still can play on Xbone.

Well, when he got banned, it absolutely blew the fuck up on twitter. I bet Major Nelson tells him "Look, do what you want with the system, JUST DONT SHOW FUCKING Call of Duty, its embargoed! Now we will un-ban you!"

I was more referring to major news outlets picking this up. That would kill any good will they have.

And it is still the company's decision to not start services until launch. Or actively block users from this. He can use his console currently. He bought the hardware, a game, a controller, everything works.

People should just relax about the console ban right now. Like I said above, as long as the ban is lifted at launch no one should be yelling and screaming.

There should never be a ban in the first place. MS does not realize how series the consequences of a ban and hand it out too easily.

i personally wouldnt have an issue with him having to adhere (not sign) to the nda to get back on early.

but i think the nda expires tuesday anyway

you don't ban legitimate customer from using your service if a product is released early.

sony isn't doing this by the way............

there are ways and means to ENSURE that you don't let people in without banning them and its actually not that hard to do at all. Firewall, ip whitelist, done.

seriously for a company the size of MS this is a monumental fuck up that could have been so easily avoided

edit: so major has tweeted. I lean more and more and even more towards automated ban rather than intended.

I've not seen sony vids being uploaded by people that got it early?

MS usually bans consoles rather than accounts.

I'm getting more and more worried about the Xbone version of Ghosts... There's got to be a reason for it to be embargoed still, even 720p wouldn't justify a complete lockdown like this.

Yep. Like I guessed. No framerate issue for Ghosts on X1.

Day 1.
Let's not get too far ahead of ourselves.

Figured bad publicity would call these guys into action. Still makes me question their blanket policies.
I actually think it makes sense to have a blanket policy prior to a new console launch. Just too much at stake to not have one. Now, how quickly and reasonably they sort out these types of issues is all on MS. We'll see, but they haven't been great in the past.

@Moonlightswami Love to know more about what happened w/ your console. Can you follow and DM me and I'll get this sorted out? Thanks.

Good stuff.

Did Stinkles ever sort out the Halo 4 dude?

Edit: Yes, yes he did. No legit receipt was produced.

Not released to the public... so what? The guy legitimately bought and paid for his console, and the retailer shipped it to him ahead of schedule, with no restrictions. So he set it up, got the update, used his console like normal, then... BAN.

Perhaps it's automated, as some gaming press folks on Twitter maintain. Perhaps it was a targeted ban because he shared info that we weren't supposed to know yet for whatever reason.

Still, he's a paying customer who got shafted because he wanted to use the item that he paid for when he got it, as opposed to waiting for a date that was not warned on the packaging or via the TOS. There are no specific rules in place about sharing images and content if you are a customer, unless you're an XBO dev who pulls TOS interpretations out of his ass.

Customers are not responsible for adhering to street dates, especially when the product itself does not warm them against it. This ban is not "fine".

It's bullshit.
At least quote me correctly next time and not take the snippets that will make your argument work. Long as the ban is lifted by launch this is not a big deal.

This really makes me want to get an xbox one, everything looks so cool. Does anyone know if we can play our game while downloading on xbox one aswell?

im talking about history. Microsoft actively bans users that play games on Live before the street date is reached

sony doesn't ban from psn

yosp has tweeted they wont ban for using PS4 early

they would probably copyright infringe videos but not ban a console.......

Buy a console, get it sent early to you at no fault of your own, and get banned . . .

. . . by the company that wanted us to trust them with a digital, DRM'd-to-hell future where they could lock you out of your entire game collection willy nilly, including games on physical media for any reason by doing so.

You know what Nelson and Penello, it's not that we're not "ready" or "didn't understand" your glorious DRM future, it's that you're untrustworthy with it.

He can still play his games... he just can't share his progress with live or connect with friends, right?

If the console was still "always online" he really would be screwed.

(In other words, what affects does it have on the console if you're not on live?)

Seems unlikely.

Target accidentally sends out Xbones to some who pre-ordered and paid for it, this dude gets it, does some very positive PR and is super excited about it, posts pics on Twitter and videos of unboxing Xbone on Youtube, Microsoft, still unknown exactly why, but they ban his console even though he owns a legit Xbone and a copy of Ghost.

EDIT: I could swear whoever I quoted said ''what's the summery behind this thread''. I might be seeing things cuz I haven't slept yet and it's almost 3am. Night peeps.

Would that really be an issue? A consumer is under no obligation to follow an embargo. If he obtained the game legitimately, I see no issue.

He also paid for a service that is actively running. Xbox Live is up.

Honestly, there is no justification for what they did. You're just being contrary for the sake of it. The excuse - because they can - is pretty lame.

Wow I was right, he got the console banned. Great going MS, you just gave one of your fans a $500+ brick.

One of the many reasons I will not buy another MS system. After the 360 Oman thing, I wont support them knowing they can remotely kill my system. Fuck that draconian crap.

Sony/Nintendo could ban you, but they rarely do. MS can ban you and they often do. That's messed up and a big difference to me. Yes its their right but they exercise it more often than not for the dumbest reasons. (oh and they dont give a specific reason for it, great!)

And I believe he got his console banned due to his tweets. He posted his XB ID all over so they tracked him in no time. This wasnt an "automated" ban like some of you speculate. All they have to do is put your Xbox live Id in a box and press the BAN/KILL SYSTEM button. Fuck out of here. Feel bad for this individual and hope he can return it and get another one.

Maybe they shot their foot with this? I mean he was like positive hype from what I saw. I think they made a bad mistake doing this.

Major has had a thankless job this whole launch. I feel bad for him, I've met him and the podcast crew a few times at PAX-E. Really hope he can get it sorted for the guy.

If it came down to sign an NDA and don't talk about it til launch day, I'd take it.

Well that's something at least, even if they say we'll re-activate it on launch then I'd be happy with the response from MS.

We shall see. they'd have take the vids down and decide if they block the upload via ban or just block the console for a week just the same.

Relieved to see Hryb reaching out to the customer in this case. Probably a good idea to come to a quick resolution before gaming press hits this story hard and more bad PR spreads.

After fixing this problem, I'd love to hear that phone conversation that Microsoft and Target will have-- if phone calls haven't been made already. There will be blood.

Oh, I know what you mean, I agree, he is trying to snuff this out quick.

However, its funny he responds to this rather quickly, but I cannot get ANY of them, Nelson, Greenburg, Whitten, or Penello to answer my tweet as to WHAT ARE THE EXACT LAUNCH DAY APPS for Xbox One.

Nobody will answer, and it is obvious that the media outlets, IGN I AM LOOKING AT YOU, are taking that Xbox Wire article that clearly stated that "the above apps will be available in the coming months" and reporting them all as Launch Day Apps. IGN left that off when they copied and pasted the rest, and ran the story calling them all launch apps. Oh well!
