I can see DH points if

  • Stealing artwork
  • Stealing assets
  • Of illegally using another companies name
  • Conducting illegal business activities
  • Impersonating someone

are untrue. Slandering someone is no good. But honestly I can't get a grasp on the whole situation at a glance sooooooo

I know everyone here thinks DH has no case but JS did make some pretty inflammatory allegations. If any of those statements are, in fact, false then he has some exposure. DH might also have to show malicious intent if they are considered a "public" figure.

They just dropped 18 games. Apparently this is their idea of a vacation.

As I recall from past Jim videos (and I may be wrong so don't take this as gospel), apparently DigiHom have a friend/Brother/relative (etc.) who is a lawyer and have told them they have a case. Might be working pro bono.

They filed without an attorney, so this is unlikely.

Wasn't Jim only saying that they were putting games together using Unity asset packs? In the interview, he was arguing that DH wasn't actually adding substantial content to the product (vs him licensing a theme song or using terrible assets in his videos).

Even then, all he would have to say is that the games looked like they were put together using bought assets. Jim was pretty clear that his problem was that the games lacked any professionalism, save for the purchased assets that were incorporated into the game poorly. Even then, DH sounded like they had no clue what he was even saying (trying to defend their poorly mixed gunshot sounds by saying no one complained about them in in other games).

They never seemed to understand what Jim was actually saying about them, so I have no clue how they think they can put together any sort of case in court.

Jealous of Jim, though. You can't buy this kind of publicity.

The case has been filed by myself without a lawyer at this point but I already have a lawyer ready to take the case. Due to the damages done I do not have the funds to retain a lawyers assistance.

I have an excellent lawyer very interested in this case but they only take retainer. Very few lawyers take contingency now for defamation lawsuits. For this reason I will also be documenting the process of this lawsuit(not the contents or personal information) and making it publicly viewable after the case is over so that others in similar dire situations can figure out how to defend themselves from online harassers and defamers.

Jim calls his audience "Hamfisted Horse Masturbators" or "Fly-Egg Ice Creams" or "Manky Cheese Fries" every video. I don't think I'm any of those things. I don't think anyone is willing to sue him over that.

The DH guy is sounds insane from the little I heard from their audio conversation. Worse, he has a wife and kids. What a role model.

I still recall it. Whether he's giving them legal advice remains to be seen. I can't be bothered to trawl through Jim's extensive back catalogue on the subject so I'll just leave it there - as a dim lightbulb going off in the back of my mental closet. ;)
 
You know, I gotta say it is impressive how one company can be so consistently shit. Congratulations to them, it is hard being so idiotic all the time.

I feel like the brothers of DH need genuine help, and i don't mean that in a cruel way.

They keep drawing negative attention to themselves through incredibly stupid acts, they need someone to stop them from doing that to themselves, they seem deluded into thinking none of the criticism is their fault, that if Jim hadn't reviewed their games, somehow their games would suddenly be best sellers, that none of their actions have influenced the responses they have gotten.

No-one deserves the abuse of internet mob justice, but when you do things that attract that kind of attention, you can't just blame it all on someone else, its like they have no idea how to take responsibility for their own actions.

Funny thing is, Jim's original target with these videos is actually Valve and its horrible job at curating their store, leaving it wide open for games that are little more than asset flipping to get some money out of people.

DH are the ones that made it about them.

There's all kinds of protected speech, such as opinions, commentary, etc. JS can offer opinions and criticize the games until he's blue in the face. What he can't do is make false statements which damage the reputation of DH. (Not saying he did, of course, only saying that JS made a number of statements of fact - not opinions - that are not afforded the same protections, unless they are true, of course).

Steam and Steam Greenlight are full of shit games and Jim is doing yeoman's work calling them out. Pretty sad that a developer would result to a legal attack instead of just trying to create a decent game.
 
Oh well, they might as well file for a new whilst they are at it. Call themselves 'Digital Suicide' because this is going to cost them a small fortune in fees. Oh, then when they lose Jim is going to have a real tasty response :)

Based on the OP and the "some context" link posted in the first few comments. It sounds like these guys were harassed fairly seriously at Jim's behest including defamation of character and personal threats and attacks going as far as receiving animal feces in the mail... And they are suing over it

And the article posted in regards to "some context" seems to say they need to drop it and just accept it because Jim's the bigger personality and has a larger following. Which IMO is not right.

Maybe I just straight up missed something but with everything I read in mind I'm siding with the dev here.

I'm confused how any rational person can see what happened and side with Digital Homicide. Did you watch Jim's videos on it?

Maybe someone else can try better (e.g. Seymour's Blazer should be black to be consistent with Jim maybe something else can represent DH). It is Season 5, ep 20 ~6:20.
On another note I found that episode is where the "Am I so out of touch? No. It's the children who are wrong" line is from.

i bet they think that they have legal standing because they "warned" Jim to leave them alone but he didn't, so that means they can sue him.
Legal case filed on 4th. Evidence of continued harassment on 16th...I don't think it works like that.

Maybe the lawyers are Lionel Hutz or Jack Thompson tier...they're probably patent troll tier though.

But funnily enough this puts the timing of the Thank God For Digital Homicide Bundle* into a rather interesting light.

They also gave away 25,000 Temper Tantrum steam keys now if everyone sells the 3 cards from those for $0.03 than is $750 for DH right there.

*-For just $1 you can have 8 DH games and a promise of another 10 if they greenlight...you can also pay $0.50 for just the latter...well latter minus the Awesome music players :p

By suing the person who didn't do it? They have tried to harass and silence any criticism against them by Jim for years at this point.
