You don't know that. For all we know he was told by the seller that they got it early from Amazon/Target or something. The same thing everyone initially assumed happened with him. He probably saw something on his local craigslist.

It can come down to intent on whether it's considered a crime and the cost of the item, etc. But normally the owner is due to recoup the item stolen and the person who unknowingly purchased said item is not due a refund or their money back.
