MS just dont give a shit about customers if they only treat them fairly when risking bad press. In this case, there is already a lot of bad press so they could easily ignore this case and the guy is boned out of $500+.

This isn't the first time a console has been banned due to a gamer actively sharing embargoed product information with others online after a street date breach.
People with early copies of Grand Theft Auto V that were purchased legally experienced the same outcome.

This is pretty messed up. This guy legally purchased a console. Then proceeded to give Microsoft the best PR they've ever gotten since they announced the system. In one night he pretty much quelled almost all the fear and doubt everyone had about the system from UI to build quality.

If this was a PR stunt it would have been really well done considering it was a week before the PS4 launched and the genuine excitement people had about getting info about the Xbox One and how it worked could have had them decide on waiting to get a PS4. As it is though, this was just some weird decision by Microsoft. Like they don't want anyone seeing what their system does outside of a controlled environment.

Has Microsoft ever reversed a console ban? They are permanent and I can't think of a single incident where they have unbanned a console.

You guys might want to start paying more attention to what these companies do. This is nothing compared to the rights that have been taken away from you by both Sony and Microsoft. Hell, the DRM thing was nothing compared to the class action shit. Interesting to see the lines people draw.

While I wouldn't expect something equal to the level of a "console ban", I'm pretty sure that any big company that is about to release a major device that relies on constant internet updates would take similar action to a person who puts information up on the internet before the product is out (via having access to the product before it launches); telling the website(s) to take down his/her videos, pics, posts, etc.

Today's tech products don't remain the same throughout their whole life thanks to internet updating. Therefore, just about every major tech company wants a tight control on pre-launch information. So while I agree that it's messed up that he's being punished for Target's error, I don't get the replies as if only MS would do something like this.

Anyway, I'm not surprised he got banned: His console was a retail system rather than a dev console, and was on the online service before release day. There's probably an automatic ban system in place. I remember a beta test when they were switching the DRM format (or something like that) for the Xbox 360 discs. Came with a fancy copy of halo reach, which installed a new version of the dash that if installed on a console not registered for that, would be unable to access live (effectively banned) until the new dash officially left beta. Seems like a similar thing.

As others have said... it's not the the product at the center of this firestorm. It's the inexcusably poor course of action that Microsoft followed in this case. If this story was about a PS4 and Sony banned the console despite being legitimately bought, paid for, and in possession early due to retailer error? I'd be ripping Sony a new one, too.

Microsoft isn't the worst company ever, but this decision is one of the worst I've ever seen.

Yeah, this is sad but true. When it comes to console gaming it's a "lesser of __ evils" situation.

They have been known to reverse them in the past. His best bet right now is to either go on the enforcement forum and post the shipping confirmation and paid receipt, or raise up a stink with the media. Though I seriously think we should PM and tweet the fuck out of Albert Penello so we can get this guy some help. This guy doesn't deserve his console banned as long as he has a receipt.

Like I said when we first learned he was banned. If he's banned until launch no big deal. If its really a perm then bad on Microsoft.

Once the product is sold, shipped, and in the possession of the buyer... companies have to be very careful how they proceed in terms of sanctions against the buyer for sharing information. Street dates need to be printed on boxes and on the TOS, advising the customer that the product may not work as intended until that date and that companies have the right to suspend or terminate the device should any information be shared publicly prior to that date.

This really would be a good test case for Legal. Part of me selfishly wants to see litigation because I want to see what would happen and what consumers' rights are if they are shipped an item that they paid for prior to scheduled release. Financial responsibility probably should fall on the retailer who made the error, leading to compensation for both the company whose product was sold early and for the customer who was burdened with additional rules and responsibilities.

The console got banned becauae it was beeing played on by a non-staff person way before launch. Happens with games too. It's funny seeing MS depicted as this evil company while all it takes ro unban the console is a phone call explaining the situation.

They did that when they took down the unboxing video, he was just oblivious to the hint. Plus he had his gamertag in the screenshots for all to see.

Well this situation isn't over yet. It seems like the guy is talking to MS right now and people from the press (e.g.: Tom Warren from "The Verge") are trying to help too.

For all we know, there may be a system in place for early consoles to get banned automatically if they aren't being used by people in the press who have been given the "a-ok".

Yes, Yes I would expect exactly that.

He bought the console, but going online is an additional service. If you manage to get into a subway network before its grand opening, you'll get kicked out, even if you managed to get a ticket early.
They can't break into his house and take back his console, but they can keep him out of the network until it opens.

Compare and contrast with the Pokemon leaks, where Nintendo sent guys armed with $60 to the guy's house to politely ask for the game back.

Why as a consumer should I care if I bought the product from a vendor in good faith?

The date is imposed by MS on the retail seller. The result of this has been the buyer getting banned. MS should be banning the seller if they care so much but they should be treading very lightly so close to launch. Not from a legal POV - from a 'We want a good public image and not imply we can and will ban people who actually like our product'

There's the letter of the law and the spirit of the law.

Whatever the payoff might be, it shouldn't be enough. If I paid half a grand for something, received it early, used it and told my friends about it, and then got the plug pulled on some functionality because I apparently broke some sort of rule by using my product as I ordinarily would? No peace offering would make my anger go away.

He got banned from XBL only . Why all the drama, just like last night with the day one patch (which was exagerated) just like holdinf flaky intel from "insiders" about the state of the OS. Making and issue where there is none. MS have every right to do what they want on XBL, banning him from the service before 22 nd seems reasonable. That guy isnt even mad becuase this isnt outragous as people are making it out to be.

Ahem... let me directly quote from Xbox LIVE Policies on Console Suspensions...

Customer Support for Xbox LIVE cannot undo an Xbox LIVE suspension for a console.
Xbox LIVE console suspensions may also include permanent suspensions of Xbox LIVE accounts as well.
