The date is imposed by MS on the retail seller. The result of this has been the buyer getting banned. MS should be banning the seller if they care so much but they should be treading very lightly so close to launch. Not from a legal POV - from a 'We want a good public image and not imply we can and will ban people who actually like our product'

Within the realms of ownership he can continue to do what he wants, he owns thw console he can play his games. XBL network fpr One is a different kettle of fish, and he doesnt have any claim until after it launches

Can rhis guy still connect to xbl via Xbox 360..? If so seems like a temp ban.That kinda is the case though. He got the console banned with no real way of unbanning it (afaik) just for using it early. How is that a good thing? If it was at least a temporary ban till launch I don't think there'd have been a problem but I don't think it is.
I wonder if he would have gotten the ban if he had not posted up all this info or as soon as he connected it online it would have happened anyway...

MS are the ones who have been saying from day 1 that Online and Xbox Live are so incredibly fundamental to the XBone experience. They only agreed that mandatory online itself wasn't required after getting a mauling.
Would I want to get involved with a company with that threat hanging over me when they've sent a loud and clear message like this 12 days before launch?
Sony may on paper have the same policies I understand, but I'd like to think they would have had the PR savvy to handle it differently.

It's too late to unban him now, because of all the embargoed stuff. Unbanning now would lend implicit support to his revealing stuff. But they can unban him on the 22nd and apologize for any misunderstanding or something with a nice care package. Maybe XBL for the life of the console or something for being the first known ban on the new XBL? It'd be cute and everyone would be all "hellz I'd trade a two week ban for free XBL for life!"
