: A Message to Unofficial Fan Game Creators

Yeah, and it's great that Woolie brings it up, but didn't go too hard about it for me.

If all these creative and talented people didn't shackle themselves to their own fandom, they could have made their own original work inspired by what they became a fan of. I get the whole "branding helps sell" logic, but it really doesn't work when you're putting in years of your life making something for free that'll probably get you stuck in a lawsuit.

imo that's the only case in which I think it was really disrespectful to the original game and I'm glad they changed. While Itoi did say something about wanting to be the player of Mother 4... I don't think that's quite what he had in mind. Thankfully this project can be it's own thing I hope.

Yeah, Undertale is definitely inspired by Mother, but it is it's own thing. I'd say it's a more honest Mother 4 than the actual Mother 4 project was.
 
And Undertale blew up in a way a Mother 4 fangame never would.

Not saying that any game that isn't a fangame is likely to get big, but having it be your own thing that you can make money out of and possibly get a career out of it is always the better alternative.

That's the thing though, it never needed that name and it doesn't need it now. I can even accept romhacks of Mother 2 or 3, but Mother 4 is a bit too much for me. Leave it like that and try to absorb what you can from it

Yet, the very same Sega shut down SoR:R in the midst of the endless sea of sonic rom hacks and fangames. I'll never understand what line did Bombergames cross that all those sonic fan games didn't.

It also helps that it was better than the game that inspired it.

Every single time a fan game is announced the footnote of C&D incoming exists. Unless you're needing help to make the project an actual reality then there's no reason to announce anything. And if you do need a lot of people to stroke your ego of your work you have so far then you best fucking dump that shit as an anon on 4chan or somewhere where they'll never find you. You give that flash drive with a trailer to a friend in Brazil and then you burn your house down and move. That's your only choice.

I'm not sure knowingly breaking copyright law and releasing something before lawyers have the chance to ask you to C&D is too smart. You're basically hoping they won't take it any further to prevent bad PR despite knowing you're going against the creator's wishes.

No, because there's no law against announcing a project or working on it. They can't "take it further" at that point. Once you release the game, you are now open to a direct lawsuit. Very different risk.

Pokemon Uranium is a great example of this.

Just call it something generic as fuck "Monster Pet Fights" and change a few things and he could've made a good chunk of change on steam. (assuming he isn't using any pokemon code.)

Like WTF are you doing, he made all the monsters as well you don't need to call it pokemon!

A C&D is a lawyer trying to protect the IP without needing to take you to court, and can be expected to be the course of action in all cases when done pre-release, and at most will leave fans and creators disappointed. Taking it further costs the company more money than the time and ink it cost them to figure out who you are and mail you a letter to cease and desist.

Actually releasing a playable game before they've a chance to act upon it is gambling on that they won't bother suing you for using their property, and arguing that it's harmful to their business while doing so.

The risk is different, and frankly, anyone who's good enough at making games to put together a game worth playing that imitates another well loved IP would be better off just spending their time making their own IP inspired by it instead.
 
  • Release 'tribute' game which is clearly inspired by a classic but doesn't infringe on copyrights.
  • "Leak" a patch or mod that changes it to a full fan game.
  • ???
  • Don't profit...that'd be illegal.

When i finished Undertale, one of my first thoughts was "welp, those mother 4 guys will have a huge uphill battle to convince people they're a better Mother 4 than this game".
 
I did a search for 'unofficial' but didn't notice this in the search results.
Good video and the list of C&D-ed game is a good reminder to keep it quiet about a fan project at least up til near completion, or when its ready.
 
I just assume most of these fan remake videos are resume padding and sending out a message of "HEY I KNOW HOW TO DO UNREAL. PLEASE GIVE ME A JOB!"


Nothing against that hustle. People just need to have the expectation that a youtube video is all it will ever be.
