I think it also depends on a game to game basis. I'm sure Take2/Rockstar powers were used here.
Call of Duty is a game that also gets released a bit early like how GTA V did and I follow it. Plenty of people playing online in them early but no one ever gets banned. In fact, Activision clarifies that when the leaks begin to happen.

More than likely they've banned both his xbox hardware by MAC address, and his XBL account. He can still play offline.
Think Instagram would of helped out to take them down. There was a guy trying to upload an entire Star Wars movie at one point that got shut down.

Yeah, that is the case. It bans your console/gamertag from connecting into LIVE. But you can still play online.
I'm sure some game purchases also get voided and any funds you had in the account plus LIVE Gold time are useless.

Doesn't Activision send copies to famous Youtubers before anyone else? I always assumed they did that to promote their game before release.

I wouldnt call him a dumbass.. He got his console banned for leaking a couple of 7 second videos. he should have leaked a complete mission or at least a 5 minute video. Only then will it be worth it. Its 2013 and you're using vine to share slideshows of the most anticipated game of 2013.

Yea, that's how I'm seeing it. He could have been playing and everything, and logged in for people to see him playing it, but what resulted in the ban was him showing the game off via Vine. If he wouldn't have shown his GT, he would have been set.

There could be a chance because once you connect it will send logs to the LIVE servers, not sure if things have changed but that's how it worked before.
