Yeah, their products are terrible and noone really wants them, they're just brainless followers. Give me a break. There's a reason the iPhone took off.

Apple cushioned from having to succeed by their cult. LOL!

Yeah. Some things Apple haters say make absolutely no sense. A "cult" that sells 187 MILLION iOS devices! LOL. How many devices per cult member would that require?

Never mind it also doesn't match up with research. For example, the iPad:

Apple iPad Ownership Extends Beyond Just “Fanboys”

The research also suggests that iPad ownership extends well beyond Apple’s most fervent consumers. Although a perception may exist that iPad owners tend to be those with a very strong affinity for Apple products, an analysis of the mobile devices of iPad owners indicates that may not be the case. While Apple is indeed the most heavily represented OEM among iPad owners, its OEM share (27.3 percent) is only slightly higher than its share among all smartphone subscribers (25.2 percent). RIM accounts for the second highest percentage of iPad owners at 17.5 percent, but this number is well below its overall smartphone market share of 28.9 percent. Meanwhile, Samsung, LG and Nokia are all significantly overrepresented among iPad owners as compared to their respective shares of the smartphone market. In addition, 14.2 percent of iPad users had Android phones.

I'd say the icons are more damning the phone design.
Really? I say theyre generic as all get-out. I've seen similar iconography FAR before smartphones even became relevant. So the "Notes" icon has a freaking notepad signifying that it's notes. Whats the big deal? Whats the cue that Apple was blatantly copied? Should it be a guy screaming "NOTES!" instead? Should MS sue for them having a similar style to icons they've used in MSN/Messenger/alternate Office icons?

The only really startling thing to me is the changing of the siding. as the iPhone 4 was introduced. Everything else kind of screams "Pull at straws" and outside of legal defense

1) they aren't doing anything different from any other tech company with valuable r&d.

2) samsung has far more to lose if Apple stops using their parts.

1) of course they are , seriously they are trying to claim that samsung ripped off the iphone ? The iphone looks like every touch screen phone i've ever owned

The iphone was shown off in january of 2007

Here is the wizard. Its a rectangle with a large screen with a center button. The iphone looks extremely similar to this also

Here is the LG prada http://en.wikipedia.org/wiki/File:LG_prada_phone_private_picture.jpg

Its just a black retangle with even less buttons (3) should they be sueing Apple cause apple made a black retangle with a single button ? The prada was announced a full month before the iphone !

2) What do they have to loose ? Samsung is one of the only ocmpanys that will be able to supply apple and if sony has to go ot other companys it might take them years to get back up to speed on production .

Samsung on the other hand will get more customers as companys fill in the gaps of the missing apple products.

1. This suit isn't just about the physical design of the phone, but the UI.

2. If a company loses out on a guaranteed 7 billion dollars worth of business they will feel the effect. Apple would not be as easily replaced as a customer as you think they would be.

And the photos? There are MILLIONS of types of flowers, let alone other things that better represent the notion of photos - why do you think both Samsung and Apple chose sunflowers?

Eastmen: You still owe me an answer - if it got lost I will ask it again for your convenience: What company that does not use patents do you advocate using?

Fair point, but does this not work both ways? I'm not sure Apple could just drop Samsung without facing very real supply issues. Apple commands a massive amount of components from Samsung and I can't think of too many other companies who could take on that kind of demand.

Agreed, however I feel as if it would be easier for Apple to get their supplies from multiple sources then it would be for Samsung to get 7 billion dollars worth of sales. Either way it's a moot point as neither of them are going to cut each other off over this.

Apple enjoys a cultlike devotion from it's followers that no other technology company has been able to emulate. Apple's success is due mainly to the fact that it has a cult surrounding the company and it's products. Nobody in their right mind would say that iPhone 1 or iOS 1.0 warranted people lining up for days to buy it, because let's face it, that first product really was a turd. But the cult always dutifully shows up and buys millions of Apple products the moment one goes on sale, which cushions Apple from having to succeed with version 1.0 of something the way other companies have to. Just look at the failure of Windows Phone 7, Microsoft doesn't have a cult following them and everyone has ignored it even though WP7 was better than iOS 1.0 at launch.

I highly recommend you watch the documentary "Macheads" it's on Netflix if you are a subscriber...It's a pretty decent documentary, and you'll actually learn a thing or two about what and who are these Apple cult followers (a.k.a. Macheads) you'll smack yourself at the back of the head for realizing how off you are with your above post.

And for blatantly claiming the first iPhone (2G) in 2007 was a "turd"...sorry but it shows how much you lack knowledge or interest about the topic on hand. Seriously do watch that documentary, you should be able to even find it on Youtube for free or something,

It's not the most in depth documentary about Apple, but at least it helps the viewer understand the history of Apple (the "pioneering" days, so to speak)

This seems like a good time to post one of my favorite articles from Marco Arment. The graphics are all fucked up, but you'll get the idea.

This is a great post, and kinda creepy how true it is.

I'd really like to hear Samsung's explanation for the notes icon.

Simple. Its a notepad. It looks like that IRL.
PTCzv.jpg

Fake edit: Not that Im saying that is not a copy, but there is only so many images you can do to make an icon of a notes program to be indicative of what is it.

ITT: Apple get mud thrown at them for the same things everyone else does in tech, finance, business, etc.

But overall I guess it's pretty worthless talking about this. Apple will do what Apple will do, and being the biggest/2nd biggest tech company will draw attention to themselves no matter what they do, whilst rolling in money.

I think the term is: Haters gonna hate

ps* I think the lawsuit is justified, but I don't think Apple want a financial settlement. The timing means it's going to be a chess move.

Also, everyone keeps bringing up the fact Apple lost to MS in a similar lawsuit, but people forget Apple wont again eMachines (or someone) about copying the iMac.

Yes, because we all know that it took only one month of development and R&D time to come up with the iPhone once Apple saw the Prada! They sure ripped them off quick!

There's only so much you can do with a touch screen device that has a slight bezel.

Jeez.
Sure, you have to get a little bit more creative.

Both are touch screen devices with a slight bezel.

The point isn't that Apple ripped off the Prada phone, it's that phones similar in form to Apple's existed prior to the iPhone. Which they did. I mean, shit, the iPhone isn't a million years away from a Palm Pilot. Same shape, same grid of icons concept.

Samsung have however been a bit silly on the software side of things. iOS isn't even a particularly good model to copy and the similarities between icons and things are just needlessly reckless. If I were Google I would be pretty furious with Samsung right now for inviting these kind of claims on the platform, because even if they only relate to Samsung's skin, they create doubt around Android as a whole.

Google are currently in the process of trying to secure Nortel patent portfolio, which I presume if acquired they'll use to threaten Microsoft and Apple, who deserve it for being such litigious scumbags in the first place.

I don't think you noticed what you did there

I never really understood it. If you're going to rip off something, rip off something that's actually good. In terms of aesthetics, iOS is butt ugly. Stock Gingerbread and even WP7 are far more visually appealing.

Ouch! Steve Jobs would be turning in his grave

Yeah..... that's the documentary with the chick who says she'd never sleep with anyone who uses windows isn't it? How rational

People are actually defending Apple? What the heck? They act like they're the only one that has right on fucking touchscreen phones while Samsung had them before them.

I seriously think Apple should fuck off and spent their precious time putting some good quality-price ratio in their MP3 players with phone function.

I'm not dumb, like, at all. You missed the "act like", the iOS style of menu is a standard menu for tons and tons of touchscreen phones now. You don't see MS and Apple suing eachother over the taskbar do you?

I'm not explaining this to you. Think as you, like, wish. Feel free to edit in "act like" to my post and you're still just as dumb.

And feel free to take on all the rest of the tech companies that defend their patents.

Why would I edit in "act like" to your post while it has flaws beyond the quote itself? I didn't say Apple was suing because they think they have the only right on touchscreen phones. I read the OP too you know?

People are defending the legitimate patent holder.

Oh god, why do I never learn :(

YEAH! Fuck App$e! Clones, i$heep, cult!!!!

I know, I'm really catching up with you guys.

I'm just not convinced of the fact that the patents and the Samsung products resemble eachother enough for a case. That's it.

This isn't just about patents. It's about trade dress. Samsung has knowingly copied key aspects of Apples designs in order to better sell Galaxy phones, and you can't do that. It's not about making a glass panel phone with a touchscreen. Trim, icons, layout, accesories, everything that could be copied was copied. The previous HTC and Motorola lawsuits were just about patents, because they use a different style of trade dress.

Nilay Patel explained this whole issue really well, both in his article posted earlier and on Macbreak Weekly yesterday.

the great thing about Apple haters over the years is that they stick to their "Apple Cult" line whether Apple is selling to two hundred people or two million people.
