Bait Car - Is this legal?

I'm watching a show on TruTV where the police rig a car with cameras, GPS, remote engine kill, remote door locks, etc. They plant the car in a parking lot with the drivers side door open, facing the parking lot exit.

Thief jumps in, drives off, gets arrested.

Isn't that some form of entrapment?

They have been doing this for years where I live. Police say they have helped so I don't really give a damn. Normal people don't see an open car and take the car.

It amazes me how clueless people are when it pertains to entrapment. It's no more illegal than OnStar doing the exact same thing when one of their cars get stolen.

Usually entrapment involves some open encouragement from the authorities, rather than just laying out a crime of opportunity.

How is that not open encouragement? haha They just leave a car there saying "here take this" and then they arrest you.
 
Is there more than one episode of this? Cause there's one channel, TBS I think it is, that shows the same fucking episode every time.
 
As far I understand it, entrapment is forcing someone to do something they wouldn't normally do. Nobody is forcing these people to attempt to steal a car.
 
No, it isn't entrapment, for it to be so the Police would have to of spoken to the thief in some capacity and told him to steal the car.

That is awesome dumb-asses got what they deserve. Do they serve the normal sentence or is it reduced since it was a plant car?
 
They should just do this for a month straight in the worst towns. GTA would go down significantly lol. Everyone would be afraid to steal any car.

Its pretty clear its not entrapment. Unless the police were encouraging a guy to take the car you cant just be "TRAPPED" into stealing something.
 
There was a channel 5 program here in the UK that enticed would-be criminals into vans that had dvd players on show and the like, then the van would lock up and the sides would come down and start driving around with music blarring saying this man is scum and stuff. Really bottom of the barrel stuff but quite funny

This show is awesome!

They remote-killed the engine and locked the doors but the guy never hit the break. So now the car is rolling down the street and he's in the passenger seat trying to kick out the window.
 
I love when they do this, and i don't consider it entrapment. I have seen them do this with bikes as well. I find the bike ones especially satisfying because bike theft is so common and the cops normally dont give a crap.

In New York as in most states entrapment is pretty hard to prove.

In any prosecution for an offense, it is an affirmative defense that

I believe it is entrapment if they are encouraged to alter their normal behaviour. They do stuff they normally would not do.
 
I watch the show all the time and laugh at the reasons they give for stealing the car

And i swear i heard of a sting to leave an Iphone on the subway and catch someone who takes it :/

honestly thats just dumb, anyone would snatch a iphone if it was left alone on a public place.
 
I saw an episode of COPS where they did that with a bike.

Put out a bike outside of a mini mart at night with no chain or lock and waited for people to steal it.


They let some air out of the tires so it was harder for the guy(s) to get away.
 
Entrapment =

Cop standing next to car and saying "hey buddy, I need your help, could you take this car down the block for me? I dont have a license"
Guy drives car and is arrested.


Entrapment does not equal placing an item out in the open and seeing what happens.


I mean, what normal person would see the car and take it? No, a normal person might look around for the owner, report it to the store, or even call the cops

Where do you live where stealing things under $300 or $400 is not a crime?
 
we have bait bikes and bait boats here in BC. its legal and I'm glad police are using it. dropped property crime quite a bit in the area.

Entrapment or not, it's fucking hilarious.

Can you imagine being the dimwit who gets caught in a bait car?

And besides, the criminals are warned. Parking lots that have bait cars are labeled.
 
I found out most of neogaf does not know what entrapment is by the FBI/terrorist threads. Most people here are pretty dumb when it comes to the actual definition of laws.
