Couldn't agree with the verdict more.

Watching some stream of some guy for some justice coalition, so sad the way he is promoting tension and violence. That's the answer to this tragedy.

Correction, 2 3 or 4 years for manslaughter. An additional 4 6 or 10 years for using a gun (though this may be out due to the need of a police officer to carry a weapon)

Assuming the police part of carrying a gun is acceptable to pursuing the gun charge, the jury did note the use of firearm in the verdict so it is up to the judge.

It's pretty much impossible to convict a police officer of anything so it is a minor miracle that this guy got a guilty verdict at all.

So I'm totally new to this, just read the op, read some of the thread and articles, saw the liveleak video. So fucked up... and to be someone just watching from the train must've been horrible.
 
Haven't been following the story, but I remember the video of the shooting. Amazing how much deference juries give to cops. The kid was laying on his stomach, being restrained by another person, and the cop shoots him point blank. Involuntary manslaughter is laughable. I don't remember much about crim law, but how could that have even been an allowable jury instruction? :lol
 
I suck at understanding law. But quick wiki check says:
Involuntary manslaughter generally occurs in only two cases. The first is when someone is killed due to criminal negligence, and the second is when someone is killed during the commission of another crime, where the intent was not to cause bodily injury or death. (This is often called "misdemeanor manslaughter".)

Murder is the act of killing another human being with "malice aforethought". Malice aforethought is defined to be the intent to kill or to inflict bodily injury, either express or implied. If a deadly weapon is used, intent to kill will necessarily be implied by a court of law.

Not sure exactly how the jury got the verdict they got. I guess they believed Meserhle and that he didn't mean to kill the guy or thought he had his tazor or something.

Because it was an accident? Just because someone dies, it doesn't make it murder. You can accidentally kill someone and even if its due to your own incredible stupidity, it can still be involuntary manslaughter. Even second degree murder is a long shot in a case like this and AFAIK it isn't even a possible verdict in many cases like this, but California is one of the places where it could be.

Yes, he was careless and made a terrible, terrible mistake. But murder? :lol I wonder how many of you guys would think your wife/brother/sister should go to prison for life if they run a red light and kill someone? Is that murder? No.

And good God time to turn this stream off, it's becoming racial now. Apparently if Grant was white, the cop would have been in prison months ago. Give me a break. Anyway justice has been served, I'm gonna bow out of this thread now.

Maybe Boogie can shed some light but I thought police officers had to shoot to kill? If not, than why wouldnt the bart guy have just shot the guys leg/arm/etc? Why shoot him so close? Why not give him a warning? Why just automatically taze someone without thinking? Even if this was a family member of mine, I wouldnt care. They made the mistake, therefor they pay for it. Just like this situation. The guy clearly was fucked up for punching him, than shoots him even though hes restraint? What exactly was the purpose of the tazing someone who is restrained anyway?

That's not quite CA's version of involuntary manslaughter.

CA Penal Code s. 192 defines involuntary manslaughter as manslaughter that occurs "in the commission of a lawful act which might produce death, in an unlawful manner, or without due caution and circumspection."

Which makes the verdict not entirely unreasonable when you consider that supposedly the jury bought the line that the officer thought he was using his taser instead of his firearm (which does seem to me to be an unreasonable finding).

Thanks for the pro tips. I think there's a biology thread somewhere, maybe you can jump in there an use meaningless anecdotes to describe another technical issue you know absolutely nothing about.

Common law murder includes "reckless indifference to an unjustifiably high risk to human life.". Ding ding ding!

I'm too lazy to actually look up all the homicide categories in the CA penal code, but it doesn't take a rocket scientist to recognize the cops defense was completely ludicrous, not to mention the fact that it was still an intentional act.

Injustices happens every day -but to riot over it...? I really dislike Oakland. Bigger injustice: an old co-worker drunk driving and killed her passenger: time served 0. That pissed me off to no end.
