I got a hands-on at Gamescom and it's actually really fun to play with.
Ok, the trailer was cool. But all this "the Batmobile is a negative" stuff combined with all the people who never wanted Arkham City but another Asylum....c'mon. It's not Batman without: A.) Gotham City and B.) the car.
It's why I skipped Asylum and was hesitant on City in the first place. Without them you might as well make a game about someone else.
Nope disagree, and I take City and Origins over Asylum. Batman isn't about shooting 50 cal guns, rockets, and blowing shit up. The Batmobile stuff looks very out of place. The Batmobile should be a means to an end, to get you places, not to drive around in blowing shit up and doing property damage for the hell of it.

Probably by making some reason for nobody to be out so that Gotham is just as barren as Origins was.

You'd still be killing a goon. I think you could see some of them in the streets (not on top of buildings only) while Batman was on the Batmobile in the E3 gameplay reveal.
Still, if you run into a gun you'd definitely kill him/her.
The car is a reaction to the trouble batman is inif it's war they want, it's war they get, but that's my interpretation.
If humans are nearby the batmobile forcefully stops using lethal ammo and only allows stun rounds of sorts.

Yea. Honestly Batman has guns on the Batmobile in most of its incarnations so I don't really have a problem with the guns. It's just that they're placing way too much emphasis on the Batmobile instead of Batman. The game is about Batman, not his car.
