I've been thinking about that even though I posted earlier, and I think that instead of being 'unsolicited goods', these are actually 'not as described' - you did place an order, so you were expecting some goods... just these are not the goods you wanted.

This is the Citizens Advice page on that subject.

One thing it doesn't address, though, is whether - if you wish - you can keep those goods anyway. It certainly doesn't say that a company has the right to demand an exchange, though!

You have no obligation to return the goods to the trader or allow the trader to collect the goods. However, it would be reasonable for you to contact the trader to explain what has happened and give them a chance to collect the goods from you.

I'm not saying refusing to return them is morally correct, BUT they have no right in demanding them to be returned and certainly should not be harrassing people for them to be returned.

With the recent news about both the PS4 and Xbone surpassing the Wii U's lifetime sales in the UK within days/weeks, and with SM3DW being outsold by freakin' Knack, I can't see the Wii U sticking at its current price point much longer. The strategy of adding value through bundled games has failed miserably, so it's a choice between slashing the price or just letting it die as far as the UK market goes.

Yeh I think it does, decided to get £25 Xbox Live gift cards for £20 instead though as I have ton of amazon credit and if you apply the voucher you have to use your credit on it.

If you mean the "Luigi " design eshop card, they're actually not scrapped. I've bought cards with that design from game (instore) before.

I just don't think Amazon are ever going to get eshop cards.

Did you sign a delivery receipt? Which is to say, could they have proved you actually received it? They wouldn't open legal proceedings for something like this, because it costs a couple hundred pounds to take something to small claims court. They're hoping and assuming people will be scared by vague legal threats and agree to return the consoles.
