No game development doesn't work that way. It's not like a lead gets to do the main character because they are the lead character artist. Any number of artists in the studio could have been assigned that. There's a million ways this could have played out where someone or a few people did this of their own volition.

But it's just speculation on my part.

Could have been known by QD and Cage. We'll never know because the settlement deal (if it goes that far) will have gag orders anyway.

Fair points, I just figured it is not the kind of task that would be outsourced or given to an intern. The leads would have a lot of oversight working with the digital character for such a long time. I imagine Cage framing the digital camera and zooming around the scene, but hey maybe he doesn't get hands on like that! Someone at the top should have realised this could happen.

in movies, they're billed as starring X Y and Z, but do the actors sue when scenes of their stunt doubles appearing in it nude are discovered? i see the angle you're trying to take, but once a digital RECREATION of the real life person is made, it's nullified your point. unless it's filmed, it's not Ellen Page. it's a recreation of her. everything in the game that visually appears to be Ellen is in fact a digital stunt double. in fact, the only REAL thing about Ellen Page that's in the game is her voice over. if there were a real life photo jpeg placed on a photo frame in the game somewhere, i would include that too, since it's a photo of real life. but a digital model/skin is not a photo of a person.

until we know whether or not Ellen knew about the skin existing or if it was part of her contract or not, then there's not really much to discuss. until a statement is out, the article is just clickbait, and there is no 'case'.

I think the EA Sports an NCAA 'likeness' case has proven that even a digital recreation can't be used without the permission of the person. And how it is used and represented is up to that person. By putting 'Ellen Page' on this box we have removed any doubt that this is her 'likeness', because it IS Ellen Page. Not Ellie who sort of looks like her, but Ellen Page playing a character. I smell a settlement coming.

It's not really the same thing. They made a nude model of her, without her permission, that didn't need nipples on it. And that's the thing, why did they bother to put nipples on it when they know they weren't going to show it?
