I fucked up gaf.
I was smoking weed with my girlfriend in a spot we really like. Weve smoked there before, many many times. Well we got caught!

As we were there a car shows in the distance, and gets close and then, woop woop, sirens on. Officer gets out comes around to my side.
Smells weed. Sees my bowl in the door. Asks for license. Asks me and my girl if we live around there. I say she does. And I live a little far. I ask him to leave my girl out of it, and he says ok.
Well he reads me my rights and then asks me if I know what a PTA is.
I never heard this term before. Promise to Appear he tells me. So apparently I'm arrested, but not under arrest. Have to appear in court and be tried, for second degree possession. They're gonna send me court date in mail.

How bad is this gaf?

You'll probably get a hefty fine and some community service. It'll be a pain in the ass.

It depends on your age. All it sounds like so far is you have a court date. If you're a minor, you'll probably get community service. If you're over 18, expect a fine. Though Im not sure how these things work out in FL.

It is really common for cops to give you a PTA for stuff like this or public intoxication or underage drinking.

Spend the money on a good lawyer and you should be able to get out of this with just some lost dollars.

If it was California, you'd probably go to court and find that the charges have been dropped. It is stupid to waste the states resources on such cases.

Second degree possession? I bet when you show up the judge gives you the option of a plea deal for loitering. Unless you have places to be and need to change your court date you don't even need a lawyer.

Also, most people who appear before a judge aren't arrested, they are just cited and given a court date. You will probably just go to the hearing and then it will be thrown out or you will be charged for a lessor crime. If you really are freaking then schedule something with a public defender.

This is an extremely minor crime and they would rather just settle up as fast as possible. The cost of jail or treatment would be more tax burden than it's worth.


Short end of it, unless you plan on running for senate don't worry about a lawyer.

I've occasionally smoked weed in public, although always in a remote area like the woods or something. No way a cop or forest ranger or some shit will sneak up on me without me knowing.
