If I'm remembering correctly, the name was explained in an earlier version of the script and kept because Tarantino liked it a lot.

Tarantino is dyslexic, and his scripts are littered with misspellings. The script leaked out, complete with his handwritten title page. My theory is he stuck with the misspelled, widely reported title out of pride, so he could claim it was intended as a mysterious artistic flourish.

It's called Inglourious Basterds because Quentin Tarantino knows how to laugh about himself and his own illiteracy. I think that's pretty much it.

There's a thing where two performers can't use the same name in SAG.
You can get trademark protection for a title in certain use cases, like for a series or anthology, or if you're going to merchandise the property, and every production of nearly everything you've seen had to have its title "cleared" before being distributed apparently, but copyright law doesn't protect titles. (From the five minutes of research I just did right now.)
