That's ridiculous

Its a defense for the homeowner in that if you kill someone that's breaking your shit in the middle of the night because you're scared shitless, you won't be tried for murder.

But it sounds like that truly doesn't apply here, because they were driving off. Dude was just pissed he got trash on his car and flipped out.

Why is it worth possibly killing (which he did do) someone for dumping leaves on your car? Upset, sure, but shooting at them? What the hell?

Sure, but what's the point in bringing up that the kids were also at fault? Why say that? What direction do you want the conversation to move in?

This is extremely tragic and it is awful he shot these kids. The property owner was way out of line here. However, I remember being a teenager in the South and having the brains to think before pranking, "These properties have families with guns...I'd rather not risk trespassing their property" because stuff like this was a possibility.

Sad that it ended this way.

What the fuck is the "terroristic act" charge for? I don't understand that.

This is my thoughts too, of all the things to charge him with, why this?

Because he allegedly "[shot] at . . . a conveyance which [was] being operated or which [was] occupied by another person with the purpose to cause injury to another person or damage to property" "while not in the commission of a lawful act".

The terrorism statute is interesting. I wonder when it was put on the books--the word's gotten pretty well warped since the 90's and 9/11, for sure.

The original version was enacted in 1975. Here's a copy of the bill passed in 1993 amending the statute (note: PDF). You can see the "terroristic acts" language predates 9/11, and seems to have been present since the original enactment in 1975.

My son will never get the joy of TPing a fellow students house, because people shoot first before asking questions.

I know right, holy fuck, this is one of the most egregious examples of why I hate guns. They almost always have fatal results/consequences.

Can you imagine ringing someone's doorbell as a prank and he comes out shooting? In what way does vandalism ever justify you to shoot someone dead?

The same kind of person who kills the neighbors for walking around on their own property.

Just happened about 2.5 weeks ago.

Guy comes out of house and blows away the new neighbor and his brother because he didn't know who they were and thought the new guys were going to rob him.

Black saw the two men looking into a shed and, allegedly without warning or calling the police, took his rifle and fired at the men.

"He shot first and then called 911," McComas said. According to the sheriff, the shed didn't have anything valuable in it. Police are still investigating why Black, who was on neither drugs nor alcohol, would shoot the unarmed men, whom he reportedly had never come into contact with before.

The police remain stumped about why Black acted in such a extreme way over something that had no value to him. "He said they were breaking into his house, but it wasn't his property," McComas said.

Although Black is white and his victims were black, McComas told the Daily News that there was no reason to believe that race influenced Black's deadly decision.

...wtf.

The shooter is black so they are going to throw the book at him unlike the white guy from Jacksonville that shot the black kid for having his music too loud.

The shooter is black so they are going to throw the book at him unlike the white guy from Jacksonville that shot the black kid for having his music too loud.

The "white guy from Jacksonville" was charged with one count of first-degree murder, three counts of attempted murder in the second degree, and a charge of throwing missiles (the FL equivalent of what AR calls "terroristic acts"). The shooter in this case (according to the news report in the OP) is being charged with one count of first-degree murder, one count of terroristic acts, and five counts of aggravated assault--not attempted murder.

So, if you want to compare the charges in the two cases, it would appear that the shooter in this case is the one facing lighter charges. (Though sentencing considerations may change that conclusion.)

Man that's what happens when retard like this guy have gun and kill innocents for such pathetic reasons.
