Microsoft Does Something That Would Make Dick Cheney Blush

Microsoft has now officially responded to an Illinois family's lawsuit in which a fire was allegedly caused by a faulty Xbox console in December of 2004. The fire resulted in the death of an infant, Wade Kline. According to the lawsuit, the fire was caused by an overheating power supply, which became so hot as to start the deadly fire. Microsoft, in response, has stated that the fire was wholly the responsibility of the family, and that it was the result of "misuse or abuse" of the console in question. Furthermore, Microsoft claims that the fire was the result of an "obvious" condition of which the family was aware. Considering Microsoft did not recall power cords until February of 2005 (on account of fire concerns) we're not sure to what obvious condition Microsoft is referring. Microsoft is asking that the case be dismissed and that the Kline family pay the company's legal fees.

Details are still weak as to what's going on here. We know that an original Xbox cord can burn down your house, but we don't really know what the family of the dead infant did to cause the fire like Microsoft claims.

MS isn't so stupid as to say something like that and then have the balls to ask for their legal fees unless there is something we don't know about. Maybe the place was a dump or something and there was all kinds of fire hazards, maybe not. Let's wait and see if we get more info.

Microsoft is asking a court to dismiss a lawsuit filed by an Illinois family that claims their infant died in blaze sparked by a faulty Xbox video game system. Among other things, Microsoft is arguing that "misuse or abuse" of the Xbox led to the blaze.

The family's "losses and damages, if any, resulted from misuse or abuse of the Xbox console at issue," Microsoft claimed in court papers filed Friday.

The filing does not provide details on the manner of abuse Microsoft believes the Xbox suffered.

According to the original complaint, filed in December, the wiring that connected the Xbox to an electrical outlet became so hot that it started a "catastrophic" fire at a house in Warsaw, Ill. The victim, an infant named Wade Kline, perished in the inferno.

Kline's family sued Microsoft, seeking unspecified damages.

"The fire was a direct and proximate result of the overheating of the game's power supply and wiring," claims the lawsuit, which is being heard in U.S. District Court for Central Illinois. Xbox seller Wal-Mart and an unnamed power-supply maker also are named as defendants.

But Microsoft's Friday court filing -- the company's first formal response to the charges -- says, in so much legalese, that the victims have only themselves to blame.

The losses "were the result of an open, obvious, and apparent condition which was known to and recognized by the plaintiff and/or others who, nevertheless, knowingly, willingly, intentionally, and voluntarily exposed themselves to said danger and assumed the risk of incident, injuries, losses, and damages," Microsoft charges.


In February 2005, Microsoft announced a recall of more than 14 million Xbox power cords, citing fire concerns.

Microsoft is asking the court to dismiss the suit and order Kline's family to pay for its legal costs.

Like I said, there's no way they'd do this if they didn't have a solid case, they're not that stupid and they hardly need any more bad PR. I'm thinking some kind of fire hazard type situation where they had a shitload of stuff plugged into one outlet or something.
 
Innocent till proven guilty. We dont know all the facts or the circumstances, however the death of any child is very very sad and my positive karma goes out to those who are in need of it.
 
Sometimes, parents sue any and everybody with wrongful-death lawsuits like this, trying to make something stick, or to get a quick settlement. I don't really buy this since we've never read of fire hazard problems, just red rings. I think this would be a more prevalent problem than this by now. Especially with the hours people have logged on Gears, Crackdown and Halo3 Beta (just to name a few). PEACE.

EDIT: And I the only one thinking that it's MS and Sony involved in planting these negative hardware stories? The timing and nature of these things just seems too coincidental.

If you're talking about THIS story, no corporation actually dares to fvck with this. A dead baby is not funny, at all.

umm this is about the Original Xbox not 360 for which they had to recall the power cables.

They're talking about Xbox not XBox 360, which had a REAL fire hazzard problem. There was even a recall. Real bad conspiracy theory you got there.

Um, the title is a bit of an over-statement if you've followed even half of what Bush / Cheney have done to the country, the military, and the government.

My question is why did it take them three -- almost four -- years to sue? That seems ... opportunistic to me. That's for the courts, I guess. Sucks if it did happen is about all you can say, and to add anything else to turn this in SystemWarz is kind of over the line.

I am an Xbot, but thats evil even to my standards. Pay the legal fee's... I bet the family will not make in their lifetime what the MS lawyers make in a year.

We do not know the circunstances, thats correct, but pay the legal fee's... isnt that like too harsh?


Anyways, I know MS is a good company at heart I remember geting my first PC as a donation from MS, so I really doubt the public is getting the whole story here.

Dunno. I have a cousin who got killed (and another injured, both infants) because of crappy construction of a fireplace. The family didn't sue but I think they should be able just to keep the company responsible. I wouldn't have posted this if they hadn't precisely confirmed that it was death because of the Xbox. Now unless they stuck the power cord in the bathtub I see it hard to argue.
 
I thought when this first happened, the family claimed to have noticed sparking and continued using the xbox anyway. I think that may be the obvious hazard MS is referring to. Although I could just be remembering wrong.

And aren't there two sides to every story?

And couldn't we in the west who make a passive choice to live our comfortable lives largely at the expense of the poorer nations of the world also be said to be evil? If so, this would be like evil people calling other evil people evil simply because the first evil people don't realize that they're evil.

You know what: I dislike Microsoft. A lot. I hate their monopolistic practices, I support open source, I hate how they limit the market, I hate that they have such shit 360 policies. BUT do not at any point just disregard the story just because I submitted it.

That is a standard demand in the United States when a lawsuit is fought or defended.

It would imagine many corporations would NOT in fact collect from a grieving family once said lawsuit was dismissed, however, I have no clue about the details of this particular case, and apparently nobody else here does either, so I really couldn't comment.
 
Kinda hard to condemn MS or the family unless there are more details about what and how the fire was caused. I mean, if it were an open and shut case, there would be much less chance you'd see MS take their route and, instead, you'd see them quietly settle.

Seriously... just wish the family the best. If Microsoft is found guilty then Microsoft did something pretty horrible... but trying to turn this into a system warz thread is just ridiculous.
