Holy shit, both lawyers have 30 minute opening statements. This could take all afternoon.
The state's case is Chael either failed to disclose a preexisting medical condition or that he had been receiving testosterone treatment for it twice a week. Prior to the pre-fight test, Chael finally disclosed that he received an injection of testosterone the day before. A drug test then confirmed that Chael's system contained testosterone that was not created by his own body. I'm not clear on whether this was prior to or after the fight.
Now they're swearing in the state's first witness whose background and area of expertise are so far too inaudible for me to figure out.

They're citing Sonnen vs Okami from nearly a year earlier as an example of where Chael did not disclose his condition that required testosterone replacement therapy. I'm not positive but I think this might be the same condition Hendo receives HRT for.

Chael's lawyer is harping on the fact that the current director of the CSAC has no records of Chael disclosing his condition prior to the Okami fight but there's a possibility that these records could have existed and were misplaced or destroyed during the transition from Garcia to Dodd. And that's about it for the cross-examination. The state is now calling a doctor as their second witness.
They're just going over the process of the pre-fight medical where Chael disclosed the testosterone therapy he was taking. I am so bored. The point they're trying to get at is they didn't have enough information to disqualify Chael before the fight took place (which I'm guessing is going to be a key part of the defense's argument). Onto Chael's lawyer's rebuttal. He looks a lot like Newt Gingrich. This is getting fun. The defense is asking the doctor if he specifically asked Chael if he was using any "hormone, or hormone replacement therapy, or steroids." The doctor admits that he did not -- he just asked Chael if he was using any "prescription medication."
That's it for the state's case. The crux of it is Chael didn't go through the proper channels to clear his testosterone shot. Now they're going over the exhibits so here's a picture of Chael looking uncomfortably vulnerable because this is more boring than a Cole Konrad fight.

Summarizing the opening statement...There is no denial or dispute of Chael taking testosterone. He was first put on HRT in 2008 by his doctor. The therapy brings Chael's testosterone levels up to the range of a healthy male of his age. Because of that it does not give Chael a competitive advantage in MMA. Prior to Chael's first fight after being prescribed HRT (against Bryan Baker in 2008), Lindland forwarded the documentation to the NSAC and Nevada told him that Chael would not need to disclose it since his hormone levels wouldn't be abnormal based on the type of treatment he was getting. The defense also claims that Chael DID disclose this to the CSAC prior to the fight with Okami. Chael also personally disclosed it to the CSAC director prior to the Silva fight. Director Dodd did not tell Chael that it would be a problem. If Dodd had indicated to Chael that this would result in a suspension or fine, he would have withdrawn from the fight. He's asking that the suspension be lifted or shorten it to time served and reevaluate how testosterone therapy is handled during the license application period.

Nothing really came of Chael's testimony or the cross-examination. Now they're calling Chael's personal physician.
And goddamn, what an amazing doctor he is. He comes in looking like Bill Lumbergh, wearing a tight t-shirt, chewing gum, and talking about "gonads" every few seconds.
That's the look of a fighter watching his doctor tell the world about his tiny testicles.
Wow, the quality of this doctor's testimony is basically destroying his credibility.
"Have you ever personally or instructed anyone to forward Mr. Sonnen's medical records to the state of California?"
"Uhh...no."
"Did you administer any tests to Mr. Sonnen when he first came to see you in January of 2008 to determine whether or not his low levels of testosterone has been caused by drug use on his part?"
"You know um...I'm not uh...at such an infrequently thought of concept that I'm uh not even sure of that."
Wow, Chael's lawyer's closing argument argues that he shouldn't be suspended because he wasn't told, after disclosing his testosterone use, the procedure for backing out of the fight. This guy's good.
Chael: "He had white gloves on, came into the prefight physical area where I took my clothes off and then he touched and handled my... questionnaire."
One member of the commission is floating the idea of lifting Chael's suspension and having his license be contingent on whether his hormone levels fall within the normal range.
