"Nintendo has been ordered to pay a former Sony engineer $15 million in damages for what is judged to be an infringement of a 3D display patent.

Seijiro Tomita, who owns a patent for a technology that displays 3D images without the use of 3D glasses, won his lawsuit against Nintendo in March.
But on Wednesday, federal judge Jed Rakoff said Tomita must accept half the damages or risk losing the whole sum. Rakoff was quoted by Reuters as saying the $30m sum was "intrinsically excessive and unsupported by the evidence presented at trial".

The judge also claimed that Nintendo's 3DS console is not profitable - a fact which was confirmed in 2011, when Tomita submitted his lawsuit, but is not clear in the present day.

Rakoff also declined Nintendo's request to overturn the jury's verdict.

"Nintendo respects the intellectual property rights of other companies and is confident that none of its products infringes the asserted patent," Nintendo spokesperson Charlie Scibetta said in a statement.

"Nintendo will appeal the jury's verdict and reduced damages award to the court of appeals.""

Isn't this lawsuit quite old? The news today that the amount was reduced from 30mil to 15 because a new judge deemed it “intrinsically excessive”.
