Nintendo wanted to shut down Smash Bros at Evo entirely

Most likely due to the same reason as the stream, it was a public performance.

Oh and the free advertising aspect doesn't magically make things right. You still have to seek permission to use a song for a production even if it is "free advertising" for the artist.

Games, especially MP games, don't work like musik. It's more like watching a sport than watching a movie/listening to music.

Attempt to punish the only people who care about Smash Bros. Good work, Nintendo.

Nintendo's decision was stupid, but... "Only people who care about Smash Bros"? I care about Smash Bros, but i don't follow EVO at all. And i suppose a good % of Smash Bros fans dont either.

I'm not familiar with Nintendo's policies, but why are they like this? I mean a reasonable answer, not just "lol because Nintendo".

What do they gain by blocking this?

My only guess is that their legal team is out of touch. They likely view their copyrights, licenses, and IP very strictly and views any attempt to make $ off of their properties as a threat.

It seems obvious to most that a high view count and publicity for this tourny will lead to increased sales of the new Smash game, but in the short term they just see private parties profiting off of their properties.

Maybe they also have a problem with the gambling-esque and risque reputation of the FGC being the spearhead of their marketing for Smash. Nintendo tries to be the wholesome, family company so they might not be happy that one of their premier titles is having it's largest event in Sin City under a community that has a rather (unfairly) poor reputation.

PS> I don't agree with really any of these arguments. I am just trying to come up with some reasonable explanations for a seemingly unreasonably stupid policy.

Piecing this together with other remarks by people at Nintendo over time, I kind of get the idea Nintendo really doesn't understand anything other than fans in Japan, their home base. Remember that Nintendo has made comments to the effect that they're still deeply worried about people becoming upset, scared, and discouraged when playing video games. People keep saying they don't "get" stuff like Internet, but I think that's not quite right. They get the internet - they are just afraid of it, because it's beyond a certain measure of control.

Combine with Nintendo of America doing nothing normally to listen to users and fans,or generally giving a shit. In this regard, that could really be a symptom of Reggie's regime. NOA could be taking the opportunity to communicate to NCL what the landscape is like in the west, not just in terms of market demands, but gaming culture. What fans want and who they are.

Instead they still don't even grasp what esports are, or that they've got people playing their games at events besides Pokemon CCG kids.

Wasn´t this all based in the inability from some people to fill out a form?

Pretty sure that was speculation, and given that Ravidrath speculated EVO actually reached Nintendo about doing it whereas the other competitions that streamed it didn't, I think it's safe to say it was a bit more than filling a form.

I care about Smash Bros and I don't really give a shit about the tournament scene.

In the eyes of the laws they are more like movies than sports.

I would reckon that these EVO fans are a bit more passionate than your average Smash Bros fan.

I don't think they understand those either. Nintendo barely communicates regardless of nationality.

Why Nintendo can legally shut down any Smash Bros. tournament it wants

...board games, which have corporate owners and legally protectable components, can't be restricted in this way. While board game makers can copyright things like the board design and actual printed rules, they can't copyright the "heart" of the game; that is, its overall design and general method of play.

Furthermore, in a 1996 case, the 9th Circuit Court of Appeals held that "playing of a [board] game is not a ‘performance’ within the meaning of the Copyright Act.”

.....

Video games are treated differently, though, primarily because they exist on a screen rather than a board. "A video game under copyright law is an audiovisual work, which gives a public performance right of the copyright holder," Dallas attorney and Law of the Game blog author Mark Methenitis explained in an interview with Ars. "Under the public performance right, the copyright holder is allowed to say when, where, or whether something is publicly performed, meaning displayed in front of a group of people larger than, say, at your house."

What do they gain by blocking this?

A. They don't have a Smash game on the market at the moment, so the "free advertising" is useless(& I very much doubt that anyone watching EVO wouldn't already be aware of the Smash series).

B. Why would a major company want to associate itself with the FGC(especially considering that Smash isn't even considered a fighting game by some of them)?

C. Nintendo are used to being paid for the use of their IP, why allow someone else to profit from it?

Personally I would guess C, with a hint of B.

It's bizarre that Nintendo would even consider interfering in the first place. What were they trying to do, protect their IP from its fans? The very people who promote and sustain it? Ridiculous.

I feel the same way about copyright claims on YouTube videos.

Sony and MS are actively encouraging new models with the share button and the gaming DVR while Nintendo are trying to stamp it out. WTF Ninty?!?

I cannot fathom how archaic Nintendo's worldview is becoming. Nintendo is a creature of tradition, but - I'm as appalled at their lack of modernization, as anyone in the 21st century could be.

A corporate entity of their size, worth billions - so keen on innovations, could be responsibly innovating their image.

I almost wished they'd gotten negative PR: imagine the pushback had they shut it down...Nintendo kills event raised with funds, earned by fighting breast cancer.

I love Nintendo - but man...

Good on Sony and MS realizing social integration and sharing the gaming experience is modern.

The problem with your assumption is that it is merely an excuse to Nintendo's online system, rather than an explanation. Fear does not mean they couldn't develop a reliable internet network or a mature account system, it means they would do so in a more careful way than their competitors, and that quality is a bit of a stretch for the way things are right now.

That said, it's clear that Nintendo is a very japanese-centric company, and it has been made clear by posts from people like Shikamaru here. Assuming Reggie is doing some encrypted work to tell Iwata how things work in the west is a bit of a jump. The reason that is the way it is is mostly attributed to Iwata due to his changes to NoA's management when he took over, but it's safe to say he probably did it for reasons beyond just his interests. The problem is not Iwata or Miyamoto, it's the whole position of Nintendo and its head members have more focus in Japan over the rest of the world, and it's unlikely they don't know the west exists: They do, they just don't think it is their focus as a japanese company.

I got no idea about this stuff, but is this the same fighting community where there has been many sexist controversies?

I could understand why Nintendo didn't want to be associated with it, if that is the case.

Streaming their game, while people are making rude comments and whatnot.

We don't know who at Nintendo they talked to, but they said they avoided asking Nintendo's legal department out of fear they would be denied.

Nintendo needs to tone down their legal department a bit; have some checks and balances with their pr department.

Their philosophy seems to be (based on what they've said and done in the public in past years) one of intense protectiveness of their IP. Now they know they will receive severe fan backlash, they'll likely simply try to monetize the use of SSB in such events in the future.

True, but they could have used it for advertising for Wii U and Smash 4; they really need sales for that. Though considering how late people who actually matter at Nintendo apparently found out about this I doubt they'll even have ads.

At what point does a company say, "The number of people in the same room who are watching a game being played is too many." they shouldn't even be able to dictate what people do with the copies they buy.

The fighting game community isn't necessarily the crowd you want associated with your family friendly beat down game.

But hey, people throw literal shit at each other at Pokemon tournaments, so it can't be that much worse!

How many concerned parents would ever even learn about the FGC if SSB ever became big in the mainstream community? (which it won't)

Not to mention that you're least likely encounter any of the shenanigans that you find the FGC notorious for at Evo being streamed online.

Eh? Do you argue this same point for music and movies? Even if just two people are watching if it is not at home it's a public performance. Numbers mean nothing.

They have a Smash in the pipeline (but don't they always have an X in the pipeline?) and Evo has made me infinitely more excited for that game's release.

Advertising at EVO is not going to be much use to Nintendo, as anyone would tune in to a Melee stream will know (or know someone who knows) that a new version is coming.
