At first I thought Pitchford was doing the usual CEO thing of just pretending their shit games are good to try and sell them, but considering he keeps bringing it up long after the dust has settled I really have to wonder if he genuinely thinks Colonial Marines wasn't terrible.

And realise that if you pre-order something, you are agreeing to give away your money with little idea as to the quality of what you're going to receive for it. If you pay beforehand and get mugged off with a shit game, who's to blame for spending the cash in advance?

I'm surprised people still give Gearbox money, they actually used Sega's money for Borderlands 2.

He's definitely NOT wrong in saying that the lawsuit was a giant waste of time. I really think the court system should be reserved for serious grievances only - things that affect people's lives in a meaningful way. This was, after all, just a shitty game and nothing more. No one lost their home by buying it, no one got sick and died from it, etc. At worst you lost 60 bucks. Definitely not worth the hassle in court.
In the end though, Pitchford really should just keep his mouth shut. No good seems to ever come from his words.
Edit : what I'm trying to say is that to agree to pre-order is to agree not to complain if you end up getting shat on, or waste time and money with frivolous lawsuits. That's all.

I believe it's also been suggested or suspected that they siphon funds from this project in order to fund Borderlands 2.
I used to love Gearbox and their Brothers In Arms IP, and when I heard they were doing a licenced Aliens game I was all over it. I attended their forums for years and got extremely hyped. When I finally saw the reviews and heard people's impressions I ended up not buying the game. I'm still extremely salty.
Shouldn't ubisoft be sued for their photoshop "screenshots" then? The ones they use even on the 360 marketplace?

Well we pre-order all sorts of goods in 'real life' before receiving them why should s/w makers get off scott free? After all if you buy a home in a new development you are pre-ordering a home, or if you order a new model car straight from the factory, in both cases you are buying on the bases of promises and past experience with the producer or their reputation.
Pre-order was only a winning game for Gearbos et al before refunds became a standard for digital goods, now the playing field is levelled I can put my money down based on faith and if the product as delivered is crap I get my money back.
That said if Randy Pitchford promised me a solid gold bar for $5, I still wouldn't pre-order and I'd have an assaying kit in my pocket for the moment he handed it over.
