PlayAsia & DDP (Customs are charging even though DDP has been paid)

I was hoping someone can clarify what is going on with PlayAsia and Delivery Duty Paid. Users on a Spanish forum are reporting that they are being charged VAT and custom duties when importing from PlayAsis even though they have paid with DDP, which means there should be no duties or taxed charged upon receiving the delivery.

I have checked the last packages I received from PlayAsia and they are not marked as DDP (even though I paid it), which is the case for games from Limited Run or Ebay from the US that I have paid DDP for.

I have written to PlayAsia and they have responded that these are additional charges placed by customs that they have no control over and are not liable for, they state you are importer and are liable for any additional charges.

I have read the European website (https://europa.eu/youreurope/business/taxation/excise-duties-eu) and there are no additional charges, items are only charged if they are not declared (and are valued over 22 euros).

They also stated that they would only pay if the Custom Authourities provide proof that the tax was not payed. As far as I know the onus of proof of declaring the product is on the sender if the duties have been paid. The proof that duties have not been paid is the Custom charge. They should provide the relevant paperwork if the duties have been paid.

This leads me to think they are charging DDP but not declaring the items, so where is the money paid in tax going?

I just want to add that I have shopped at PlayAsia for many years and never had a problem with them, so I am a little sad at was is going on, there are few good importers left online that are reasonably priced.

Can anyone share experiences and bring a little light to this situation?
