I came back to this thread because I figured I'd share something somewhat constructive.

I've been to college, I know tons of people with modded devices.

Even now that I work at a decent full time job, I know tons of people at my work with modded xboxes. Its pretty unreal.


I also know tons of people with legit xboxes who don't buy games. My point was to market to them, get them to buy games by releasing the new games at cheaper prices for a limited time. It seems to have worked to batman's and borderlands' favour.

Back on topic, good move by Micrsoft and is also business smart. They know these people will buy a new console if they can continue where they left off I suppose they may not even need a new HD, just wipe their old one.

If they can make new consoles somehow unmoddable then they are onto a winner. (I dont think we will see this till DD is the norm though)

I feel sorry for parents who may be tempted to buy a 360 off ebay as it could be a minefield now.

Yeah, saying "not banned" clearly means "to market to pirates, get them to buy games by releasing them at cheaper prices." And not that you are a pirate who is bragging about not being banned by the topic of the thread.

You know why? What happens to murders/burglers when a crime is committed and caught versuses what happens when you dl halo4 on your hax box.

not saying their equal but right now digtial media theft is about as serious as jay walking (actually probably less so).

the next couple decades as it applies to piracy law and digital downloads is going to be fun.

If all he said was "not banned" then it could easily be a misguided joke. You need more explicit evidence before you can start accusing people of piracy.

I wonder if these ban waves (on xbl) are foolproof, laser guided accuracy bans.

It would be interesting to know if they ever banned people incorrectly, because you can guarantee no-one would believe someone who complained.

This, but for th complete opposite of what you think will happen.

The change in attitude is going to be staggering and damn-right insulting to those with old-fashioned views. But I'm out before i'm tempted to dance with the ban-hammer.

Yes. I seen a picture of a guy who was banned for just a few days after playing forza (real copy) before the street date. It seems that if you pirate your console, the console gets banned. If you play a game before street date and they can't figure out if it's a copy they ban you for some days.

Maybe they check during those days to see if your console is modded?

1997 Ammendment to the Copyright Act said:
The United States No Electronic Theft Act (NET Act), a federal law passed in 1997, provides for criminal prosecution of individuals who engage in copyright infringement, even when there is no monetary profit or commercial benefit from the infringement. Maximum penalties can be five years in prison and up to $250,000 in fines. The NET Act also raised statutory damages by 50%.
In 1997, non-commercial copyright infringement was made a criminal offense.

It should be a civil offense, with a fine, like speeding or jaywalking, but it's not. This is the sort of thing that should be well-enforced, with relatively small penalties for breaking the rules. Instead, we take a random handful of people out of thousands and stack enormous penalties on them.

The current system is ineffective and unfair. To be fair, the penalty should be proportional to the crime. That is, you shouldn't be fined for more than 10x the value of the liscence you infringed upon. To be effective, it should be enforced such that there's a reasonable likelihood of being caught.

Microsoft's approach is one of the most reasonable options on the table.

Or just waiting a couple months and buying them new for $20 or less...Well in the US anyway. I haven't paid $60 for any game this gen and I have 100+ games across all platforms. Games just don't hold their value.

With the older models that have the Pandora exploit, there's not a damn thing Sony can do about it (Pandora used an exploit in the CPU code, which Sony can't touch via firmware). That's why they needed to put new models out to stop it (later 2k models and the 3k have that bug in the CPU code fixed so Pandora doesn't work on them).
 
This may be a good thing for XBL as a whole, as a lot of pirates are kids who can't afford a lot of games, so they hack their drive firmware using easy to follow guides (it's sickening how weak 360 security is), fewer asshole kids, better experience.

the 360 security is tough as nails, still hasnt been hacked, the dvd drive however, isnt

So what happens if one uses an internet hosted image as a replacement for making a backup themselves? I mean, making backups requires certain hardware. That hardware has to have its costs validated from somewhere. Which means either having a lot of cash, making a lot of backups or making backups for the purpose of sharing them.

The law may excist so that people can still make backups for research purposes, but those are usually made using 'low / common' technology. So I always find the "making backups" is still okay argument kinda fishy, because it usually involves non-common technology.
 
Anyone know exactly why Microsoft doesn't specify why so and so's console has been banned?

Most of these people complaining to MS know exactly why without MS telling them. However there have got to be some legit cases where kids will lie about their console being modded and the parent will get into it with MS with no knowledge of this. I know they don't have to but it just seems like a dick move.

No, they dont know exactly. They know they got banned for piracy, but they dont know how.

There's no excuse; there's reviews, previews, videos and so on to back up demos online as well as countless forum discussions etc.

Piracy isn't the answer, but I do want to address the point you raised. The concerns he raises are valid. The solution he uses is not. If I trusted my dollars to fucking reviews and GAF hype, I would be fucked twelve ways from Sunday. I've taken a flyer on such things in the past and I'd have been better off just flushing my money down the toilet, seriously.

That said, that certainly does not mean I have no choice but to pirate. It DOES suck to get burnt by a $60+ paperweight
