Why would a pirate buy a new system though anyway? It's only going to be more difficult to mod, and you can get an older, more hackable pre-owned model for like $130 from Gamestop.

as someone pointed out, with the pics of a hair dryer, etc, it's trivial to remove the seals without cracking them.If you've cracked the seal on both systems, I don't know why Microsoft would replace either one.

It seems like the easiest way for them to do it.
