So marlon wayans plays this little guy who disguises himself as a baby to get away from the cops and a couple takes him in. In the middle of the night he jumps into bed with the wife, and thinking that hes the husband they have sex.. multiple times even.
Is this not one of the most disturbing scenes in cinema history? what were they thinking.

I haven't seen this movie, so please clarify: what makes this rape? That she had sex with someone other than her husband?

Don't think about this too hard. In the context of a goofy comedy movie where a ton of other ridiculous shit happens this is just another goofy ridiculous thing to happen. The goal of the scene wasn't to make you think "damn did she get raped?" Its to make you look at the irony of the situation and laugh. Little man was so abstract and unbased in reality that it doesn't feel so weird to look at the scene and not immediately think rape. Shit I never even thought about it until you brought it up but its not vile or horrifying because its not to be taken seriously
Edit: to clarify I'm not saying its not taasteless, just not disturbing or horrible

I believe they were going for comedy. But the Wayans fail at that a lot so it's understandable if it wasn't funny.

So like Marlon Wayans is this 40 year old midget and then Carrie Washington and the other Wayans adopt him because they cant have kids I think and they think he's a baby. Theres a scene when he leaves his crib or something and has sex with Carrie, thinking it is her husband.

Strange thing to obsess about OP but whatever.

In complete darkness, a midget(disguised as an abandoned baby) sneaks into the foster parents' bed and has sex with the wife. The wife is "willing" because she believed the baby was her husband, who was soundly asleep.

I really don't see how this isn't sexual assault.

Well this thread has revealed people have interesting discrepancies in what they consider rape.

Its actually not. Its the difference between two different legal concepts called fraud in the inducement and fraud in the factum.

If a guy convinces a girl to have sex with him because he says his penis cures cancer - it is not considered rape. If a guy tells a girl to close her eyes and he's going to insert a special device that will cure her cancer - it is rape. The difference between fraud in the factum and fraud in the inducement is what the fraud relates to - the act itself or something collateral.

If I recall revenge of the nerds did something like this. Nerd dresses up in a Halloween costume and sleeps with jocks girlfriend who thinks it's the jock. But she's cool with it after he reveals it's him because he was so good at it.... I think that's how it went down.

Yes I'm referencing a terrible movie from 84

You're trying to think deeply about shallow movie. Don't do it OP, you'll just hurt yourself.

There's nothing terrible about Revenge Of The Nerds.

What if his penis does cure cancer?

Yup, the main nerd rapes the hot cheerleader by pretending to be her boyfriend in a darth vader costume. But it totally ok because she liked it! blegh.

One of my favorite movies as a kid. Once I was older the realization that that scene was fucked up really disappointed me.
