I suppose if they changed the cover to make it less noticeable, they could get away with it. It's not like Xros Wars is conservative when it comes to stuff like this anyway.

Is the picture in the OP the new cover artwork for the 3DS version? If so, just move Veemon over a bit to cover up the "naughty" parts, slap a logo/title on it, done. Family friendly cover, Mom will never know the difference.

My friend recommended it to me and after watching the first episode, I was completely beside myself as to how gratuitous they were with the boob and panty shots, even for the underage girl. I checked out reviews online and fans seem to translate this as "humor."
