The felony likely has to do with the property damage charge not the assault and battery. Those laws are based on property damage amounts. Anything less than $1,000 is usually a misdemeanor while anything above is a felony.

The same applies to theft. Anything less than $1,000, say if you shoplift a pack of gum, is misdemeanor petit larceny. Now, if you stole something more than $1,000 that's a felony and it would be grand larceny.

It has nothing do to do with race. Cops have to go by the statutory code.
