Yeah they'll tweak the emulator if issues appear with any particular title (everything gets run through a QA test), here's what Phil Spencer said on Giant Bomb:

The new leadership team made the decision to invest in backwards compatibility about a year ago, they emulate the full 360 hardware level and it's running the OS, frame by frame performance, Xbox Live thinks you're on 360 so you can play with people who are on 360, Xbox One sees it as an Xbox One game so that's why Xbox One features work too, emulator runs exactly the same for all games unlike original Xbox emulation on 360 where emulation didn't scale well and they had to 'shim' on a title by title basis, emulator will be tweaked if any issues are found as they bring more games over, for 3rd party games they just need permission from publisher and then they'll run them through a QA test, Kinect games won't work, currently figuring out how to do multi-disc games.

They said it is just one of the ways they will prioritize the order of games they try to get on the service. They did commit to include all first-party games that don't have issues (eg licensing)

Licensing issue...there's no chance of that game coming to any platform ever again most likely. Sad, because I'd love an Ultimate Alliance 3

There are a couple Xbox Originals games on there like Chaos Theory. Probably MS just generated the list automatically from the GoD and XBLA game directories, and since Xbox Originals got moved in with GoD some made it onto this page.

Probably because it is published by MS, and they've already said they are trying to include every first party game (which includes a shitload of xbla games I believe)

I would like to see a statement from Microsoft about games that won't be joining the program due to licensing issues.

I'm tempted to make a thread gathering statements from companies about thei games not joining the BC program for any particular reason, though it may be imprudent before the formal launch. Some attorneys might look over the old paperwork and decide it's cool, such as how Nintendo still sells Wiiware and VC in Wii mode on the Wii U.

Kinect games won't be listed. New kinect is pretty different from the old one (faster, higher resolution, some stuff done onboard) so they probably can't emulate the 360 kinect well.
