Philips asking for damages, ban on sale of Wii U due to patent infringements

Yeah Philips is still around, we used to use their (often shitty) ECG machines at work before switching to a different manufacturer.

I'd be very surprised if Nintendo doesn't win this decisively, and it does make me wonder if this is preamble to what we should expect when their QoL stuff starts to show up.

If that's the patent, then that's also not how the Wii Remote works.

There are a lot of patents now that are basically duplicates of other patents, but the actual details of which is "legit" is so deeply mired in the law that it would take a lawsuit to figure it out. It's entirely possible Nintendo has a patent that covers exactly how their system works, and Philips has nothing to lose by attempting a shakedown except for the legal fees. Their own patent is not in danger so long as the case does not reach a ruling or a PTO investigation.

Sadly we just have no idea what's actually going on from the outside. It could be a legit case. They could both have patents covering this. One side could just be reaching for dollars. But all we get to see is Philips rattling the sabre, Nintendo's vigorous denial lulz, and much...much...later....a trial, if a season worth of 'Suits' isn't enough to solve the issue.

About the only thing in this case that could possibly be interesting and immediately relevant would be if Howard Lincoln emerges from Mariners retirement like a new Smash Bros. character.

This is pretty messed up for a company this size of Philips. The infringement is dubious and doubly so because Philips never developed a product like that I'm aware of. In fact, Philips and Nintendo don't even exist in the same industry. It would be nice if Nintendo could take these guys to the cleaners.

Wait they're demanding a trial by jury. Anything could happen.

My head hurts.

6 point perspective is real...

Maybe it is trying to demonstrate the room from the view of multiple cameras.

Still laughing about that drawing.
Really, wtf? My 5 year old daughter could've made something similar, only colorful instead.

The woman/melting monster is icing on the cake. And that door... Amazing.
Like science reports using colour gets you marked down n the patent world.

But they usually get perspective right...

Perhaps Phillips would settle out of court if they could get some branding on the console.

Instead of the Nintendo Wii-U it could be the Nintendo/Philips Pee-U.

I'll get my coat.

Philips is literally here right now doing an installation at the hospital I work at. I couldn't imagine this actually blocking the sale of the WiiU entirely, but they could get an out of court payday.

Just going OT briefly as a Biomed, which ECG didn't you get on with?

Sorry for the late reply, they were Pagewriter Touches.

I suppose "shitty" was a poor choice to use, as there are a lot of things to like about them compared to some others out there, but we were always having issues with the damn things, ranging from frequent paper jams (even on brand new replacements) to closing the lid causing screen burnout, and even into software issues such as failure to load OS on startup, and touchscreen calibration requiring constant resetting. I'm glad to be rid of them even if I'll miss the nice big screens.

Philips went into Patent-troll mode, since last year. They bought a couple of pending patents, yep just pending, and now they go after every big guy. Nintendo, Microsoft, Oracle, Apple... you name it.

But not Sony. They are part of this patent trolling.

This could be Nintendo's excuse to start fresh with a next gen console. It's still not too late.

Sony got enough revenge for both companies and then some.

This is what I was thinking. Blame the discontinuation of the console on Phillips so your fans can't be mad, then release its successor.

Mirrors a lot of what I've heard about the new pagewriters too, especially the paper drawer. There's still a ton of old HP Pagewriters kicking about (even had an ECG off one myself a couple of weeks back) people seem loathe to let them go :)

Apologies for mild de-rail all.

1. User interaction system, comprising:an electrical apparatus;a portable pointing device operable by a user for pointing to a region in space;a camera taking a picture, which camera is physically attached to the pointing device so that in operation it always images the region pointed to without imaging the pointing device;a distributed digital signal processor, the digital signal processor being capable of receiving and processing the picture, and capable of transmitting user interface information derived from the picture to the electrical apparatus;at least one localization beacon that emit electromagnetic radiation for use by the digital signal processor in order to recognize where the pointing device is pointing;wherein the digital signal processor estimates a motion or a motion trajectory of the pointing device; and, wherein said digital signal processor recognizes where the pointing device is pointing without utilizing any electromagnetic radiation emitted from the pointing device itself.

I think that in this case the patent only is now taking affect with the Wii U as they slapped a camera on the remote (think in this case it was patented in conjunction with a medical application).

Correct me if I'm wrong.

Clearly a ripoff of the GBA SP. Nintendo should sue.

The perspective on that Escher doorway on the right hand side is doing bad things to my eyes and brain. And why does that woman (?) in the foreground appear to be melting? I mean, I know these diagrams just have to be functional and not particularly pretty, but I'm sure they could've found someone on staff who uses their hands to draw instead of holding the pen between their toes.

Lol the doorway to hell

Ah, good old Colin Birss - the man who famously said that Samsung's tablets weren't "as cool" as Apple's in the Apple/Samsung case...

I wonder if the younger gamers can really appreciate why this picture in particular is as funny as it is considering the topic.

I know I can't.

I get that it's from the (supposedly terrible) Philips CD-i games but I wouldn't even know what a CD-i looked like if I couldn't google it.

Yeah, they used to be quite big in consumer electronics (but that, obviously, is no longer the case). They are still one of the biggest, though, when it comes to creating medical devices.

They also make some great headphones.

Kind of surprised at the ruling. Probably warrants a new thread.

Was Phillips seeking enjoinment of Wii line sales in the UK as part of this case? And if so does that go into effect even while an appeal is being lodged? (Not that it will make a huge difference I suppose.)
Or were they just seeking monetary damages?

Wonder what the settlement will be......

Another unprofitable year on the way for Nintendo potentially...

There won't be a settlement for a good wee while - they're going to appeal, and it wouldn't be the first time they've pushed back and won on appeal. One to watch.

This drawing. Oh my god. This drawing!

The more I looked at it the harder I started laughing, and all the posts about it kept me laughing non stop through the thread. It's a masterpiece. This needs to be hanging in a museum somewhere.

Seems like a bogus ruling seeing how the patents don't even match up well..
Maybe Nintendo's appeal will go through. Otherwise, the PS Move and Kinect will be affected too as they actually match up more..

Still sour about the CDi.

would be funny if Nintendo counter sues with the CDi failure and how that caused them huge losses by being a shitty product and making them weak for the competition to beat them in the N64 gen.

it's as bogus as phillips case anyway.

Bullshit. Patent was filed after the Wii was launched and doesn't even match up well.

Did Nintendo have patents for the wiimote with he GameCube?

Edit: yup thoght so http://m.joystiq.com/2009/01/09/patent-shows-wiimote-was-originally-a-gamecube-peripheral/

I'm sure this was brought up during the case, and that if Nintendo had any of their own patents that were relevant, they would have countersued for revocation of Phillip's patents.

And I'm not sure where you're getting this "Patent was filed after the Wii was launched". The Phillips patents in question are EP0808484 and EP1573498, which were filed in 1995 and 2002 repectively.
