No, AFAIK none of it is on the disk, but everyone downloads it as a patch to keep online uniform.

If I'm not mistaken, it's in an update... You install it even if you don't buy it so that there's no compatibility issues online, like the OP said.

No, there are compulsory patches for everyone, regardless of whether they have purchased the DLC or not, but that doesn't mean that these characters are on the disc.

DLC is included in the updates. You need a key to activate it legally. The reason the characters are included in the updates is because their files are needed for online play.

This looks like it's on the fly RAM editing, similar to the Mario Kart 8 hacks (notice how they are changing the characters "selected"). Not a method that's widely available (only a few people know how), but could be eventually released in the future. I really hope people will support the DLC and actually purchase it, and that Nintendo patches the exploit.

All characters must have an ID, what I think the guy do is replacing this ID on other character, thus the game selecting the "wrong" character, I really don't know if they can patch it, all the DLC character assets are right there

Well this was due to them releasing the patch early on Japanese servers. They have hopefully learnt from that.

Also we've heard nothing interesting from the latest patch as far as I know so I guess they're being a bit smarter.
