Oh. That is really odd to me. I misunderstood the pic and thought that was a physical button, but It's a touch button. Man. If they omit buttons...I hope the screen has a good simulative feeling of pressing a button. I'm wary but hopeful about that....
HONESTLY, I can't wait for their next innovation, it keeps gaming fresh and interesting.

So that's free form display and cloud computing seemingly confirmed in whatever the NX is slated to become. What other patents did Nintendo toy with during the lead-up?

Wouldn't games have to be specifically built for a free-form display? Doesn't seem to go in line with the shared games thing we've been thinking for some time.
While something like this looks cool, its not practical for gaming at all. The buttons block off huge chunks of what you are seeing and could negatively impact gameplay.
Look at the patent, the buttons, while still looking like being part of the screen, never block the action.
Edit: Actually looking at it again there are a couple that do block gameplay. I'm not sure I'm ok with that AT ALL

This is a fan-made mockup. A professional dev would put touch controls in the obscured areas since those are easily-reachable by your thumbs.This would only work if you have invisible hands.
I think of it like those projectors that expand the image/colors on the walls around your tv. the actual content is between the buttons but there is unimportant imagery that continues on to the edge of the screen.

Holes are formed in left and right end portions of the display panel and the touch panel, and two operation sticks are provided through the two holes.

The crux of the issue is if this controller or "gimmick" can capture audiences the way the Wii Remote did. If it's another hit, Nintendo isn't going to need third party support to be successful.
